HomeMy WebLinkAbout1410ORDINANCE NO. 1410 l 2 3 4 6 8 7 8 9 10 I1 12 13 14 16 18 17 18 19 20 21 22 23 24 25 28 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "AR--MH" (AGRICUL- TURAL RE5IDENTIAL-MOBILE HOME} DISTRICT, PURSUANT TO ORDINANCE N0. 475, AS AMENDED. The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475 of said County, being the Zoning Enabling Ordinance of said County, as amended, DO ORDAIN as follows: SECTION 1. The hereinafter described area, situated in the County of Butte, State of California, shall b~;and it is hereby zoned as an "AR-MH" (Agricultural Residential -- Mobile' Home) District, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County, near 4roville, California, m+a.~re: particularly described as follows: Commencing at a point on the West boundary of Lot 3 in Block 111 of Subdivision No. 1 of the Palermo Citrus Tract, as per map recorded on wall map No. 14 in the Off ice of Butte County Recorder, at a point 334.61 feet N~:>~:°<;509' E of the Southwest corner of said Lot; running thence S 89° 23' E, parallel. to the Southerly boundary of said Block 111, 660 ft. to the centerline of Carmel Ave.; thence N 1° 09' E along the centerline of said Carmel Ave., 575.89 ft. to the centerline of Pinecrest Ave. {Wyandotte Ave.); thence S 82° 0$' W along the centerline of said Pincrest Ave. (Wyandotte Ave.), 667.90 ft. to the West end line of said Avenue; thence S 1° 09' W along West line of said Block 111, 475.89 ft. to the place of commencement. Containing $ acres, more or less. SECTION 2. REGULATIONS FOR AN "AR~MH" DISTRICT: The following regulations shall apply in an "AR-MH" District: it 1 2 4 6 6 7 8 9 10 11 12 13 l4 15 18 37 18 I9 20 21 22 23 24 26 26 2.1 USES PERMITTED: a. Single-family dwellings. b. Mobile Homes - to house one family, when such mobile home is the only housing facility located on the premises, provided the following conditions are conformed to: 1} The gross area of the, mobile home shall not be less than 504 square feet. Z} All sanitary facilities shall conform to State Statutes and regulations and to local require- ments of the Butte County Health Department. 3) All electrical installations shall conform to State Statutes and regulations as administered by the Building Div~:sion of the Butte County Public Works Department. c. Accessory buildings pertinent to the permitted uses. d. Agricultural uses. e. Livestock, subject to requirements as follows: 1) Minimum lot area to be devoted to residential use sha11 be not less than eight thousand, one hundred twenty-five (8 ,125 } square f eet . 2} Exclusive of the area devoted to the residential use, the following lot or parcel areas shall be required for each animal raised or kept on the premises: a) For each horse or head of cattle over one -2 - 1 (~.) year of age -- eight thousand one hundred 2 twenty-five ( 8,125} square feet . 3 b) For each head of swine over ten (10} weeks 4 of age -- eight thousand, one hundred twenty- 5 five (8,125} square feet. 8 c) For each- head of sheep or goats - two ? thousand (2,00} square feet. 8 2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT ~ IN EACH CASE: la a. Duplex dwellings and multiple-family dwellings. 11 b. Golf Courses. country clubs, if permitted, would 12 permit accessory uses such as driving range, pro l~ shop , cocktail bar, :restaurant . I4 c. Public and quasi--public uses including churches, 15 firehouses , hospitals , parks and playgrounds , I6 schools and public utility buildings . 17 d. Commercial poultry farming and livestock farming. 18 e. Veterinary clinics, outpatient. I9 f. Nurseries and plant gardens. 2~ 2.3 LOT AREA REQUIRED: Minimum required area of lot per 21 dwelling unit shall be not less than eight thousand, one hundred 22 twenty-five (8,125} square feet. 23 2.4 LOT WIDTH REQUIRED: Minimum lot width shah. be not 24 less than sixty-five (65) feet, ~ 2.5 FRONT YARD REQUIRED7: Minimum front yard shall be 28 fifty (50) feet from the centerline of the road, except where -3 - I the road is classified by the County as a Federal Aid Secondary 2 Road, the miniz~um building setback requirement shall be fifty-five 3 ( 5 5 ) feet from the centerline of the raod . 4 2.6 SIDE YARD REQUIRED: Minimum side yard shall not be 5 less than five {5} feet. 6 SECTION 3. A11 uses of Land within the district not ~ specifically authorized and permitted in Section 2 are prohibited, $ SECTION 4. Tn compliance with the provisions of the 9 Zoning Enabling Ordinance, the same is hereby amended by adding 10 this Ordinance in full. ~-~ SECTION 5. The penalties for the violation of the zoning I2 hereby imposed within the district shall be as provided in the I3 Zoning Enabling Ordinance. In compliance with the provisions of I4 the Zoning Enabling Ordinance, this ordinance shall ~~.: from and I5 after its effective date become a supplement to and part of the 16 Zoning Enabling Ordinance. I7 SECTION 6.
