"J..e ' �I�1/ �l; ub�I�... r, r ,a r , ! r r � �,✓ � l Y r� J � � r l r �i/��i�,,r/'folfr�ll re ry riil�,fi;,�� r l r �r i f, r /rr/i�,,,/�aii�!,f�Grri /.,.,,r,,i�r✓r Resolution No. 14-126 RESOLUTION MAKING APPLICATION TO THE BUTTE LOCAL AGENCY FORMATION COMMISSION REGARDING A PROPOSAL FOR AN EXPANSION F POWERS WITHIN A COUNTY SERVICE AREA FOR ROAD MAINTENANCE WHEREAS,the parcel owners within Sierra Del Gro (County Service Area 4) willl benefit from road maintenance services, WHEREAS, Butte County Public Works and the Board l of Supervisors of the County of Butte supports the expansion of powers within CSA 4; and WHEREAS,the purpose of the expansion of powers within CSA 4 will be to provide for road maintenance, drainage, water quality, and street lighting; and WHEREAS,the expansion of powers is categorically exempt from the requirements of the California Environmental Quality Act by CEQA exemption 15301; and WHEREAS, no further proceedings for the expansion of powers will involve levying and collecting additional annual charges on the tax roll shall be instituted by this Board or requested by its members until approval of the Butte Local Agency Formation Commission ("LAFCo") is obtained, except as otherwise provided herein; and WHEREAS, it is the intention of the County of Butte to expand the powers within CSA 4 if approved by LAFCo; and NOW,THE EFORE, BE IT RESOLVED, by the Board of Supervisors as follows: 1. That an application is hereby authorized to be made to the Local Agency Formation Commission in accordance with the Cortese-Knox Local Government Reorganization Act of 1985, as set forth in Division 3, Title 5 of the California Government Code, commencing with Section 56000, for the expansion of powers within a County Service Area ("CSA"),with all parcels benefiting from the expanded powers.. 2. That the boundaries of the expansion of powers proposed within the CSA are identical to the established boundaries of the CSA. 3. That the type of expanded services proposed to be provided is road maintenance services in addition to the currently provided drainage, water quality, and street lighting. Roadmaintenance will not include any improvements. Road maintenance services will not require the establishment of a maximum service charge. 4� That the expansion of powers to provide road maintenance of existing roads within CSA 4 is categorically exempt from the requirements of the California Environmental Quality Act by CEQA Guidelines exemption 15301 (Existing Facilities). 5. That the Butte County Director of Public Works is hereby authorized and directed to execute and submit on behalf of the County of Butte an application and all other relevant documents to the Butte Local Agency Formation Commission regarding a proposal for an expansion of powers within County Service Area 4 for road maintenance. 6. That LAFCo approval of the expansion,of powers within CSA 4 and the Certificate of Completion shall be recorded when the expansion of powers conditions have been fulfilled: 7. That the Clerk of the Board is authorized and directed to file a certified copy of this Resolution with the Executive Officer of the Butte County Local Agency Formation Commission.
