HomeMy WebLinkAbout14-153 tFwd 1 � � F 1 1 r //.� i ,,,,,,., F r/f,/, „c �,;,,�✓,%r�/ 1/ „/ ,iilGi� �, ,/ /i�,/1,�...c „/�,.�/�11/ „li l�%�. % . ��/rh � � / ,iI 1 F //, � l�,// ✓.L c1 l! � �e (� �-, ��/„�J ,�,8,/ � l� `i;f%�/r�l%1// +U/%�/%n/%�i �r�% f /, %.� ,�,;.. i �/ i„i., s „t 'r/ r, -a r .l¢/ r �., ,1 6 � � / d..l �// �r� ✓� ..,. /. rrilry�' Resolution No. 14-153' RESOLUTION AUTHORIZING AN APPLICATION TO THE BUTTE LOCAL AGENCY FORMATION COMMISSION REQUESTING PROCEEDINGS FOR THE ANNEXATION OF PROPERTY NOW LOCATED IN THE UNVIC PRORATED TERRITORY OF THE COUNTY F BUTTE TO THEN COPORATED TERRITORY OF TIME CITE”OF OR VILLE, SOUTH ORO IILLE "AREA A" WHEREAS, Government Code Section 56375(a) requires the approval of the Local Agency Formation Commission (LAFCo) for the annexation of properties within the County's jurisdiction into the City's boundaries; and EDEAS, on October 7, 2014,the Oroville City Council adopted a resolution of intent directing staff to bring back a resolution of authorization for the initiation of application by the City of Oroville requesting the Butte LAFCo to take proceedings for the annexation of South Oroville ",area-A" (Exhibit A-2); and WHEREAS, the Oroville City Council intends to consider a resolution on October 21, 2014 directing staff to submit an application and all other relevant documents to the Butte Local Agency Formation Commission to take proceedings for the annexation of South Oroville "Area-A"; and WHEREAS, the County of Butte supports the adoption of a resolution by the Oroville City Council on October 21, 2014 authorizing the initiation of application by the City of Oroville requesting the Butte LAFCo to take proceedings for the annexation of South Oroville "Area-A" and WHEREAS, it is the intention of the County of Butte to submit an application requesting the Butte LAFCo to take proceedings for the annexation of South Oroville "Area-A" no sooner than 30 days from the date of this resolution, if an application is not submitted by the City of Oroville; and WHEREAS, all of the parcels in South Oroville "Area-A" are within County Service Area (CSA) 17 (Exhibit B_2), which has two zones of benefit: pone 1 provides funds for street light maintenance and operations and Zone 2 provides funds far alley maintenance; and WHEREAS,the County of Butte finds that the annexation of South Oroville "Area-A" is categorically exempt from the requirements of the California Environmental Quality Act by CEQA exemption 15319, NOW,THEREFORE, BE IT RESOLVED, by the Board of Supervisors as follows: 1. That an application is hereby authorized to be made to the Butte LAFCo in accordance with the Cortese- Knox Hertzberg Local Government Reorganization Act of 2000,as set forth in Division 3,Title 5 of the California Government Code, commencing with Section 56000, for annexation of property now located in the unincorporated territory of the County of Butte to the incorporated area of the City of Oroville, South Oroville "Area-A".' 2. That the boundaries for South Oroville "Area-A" are those boundaries shown in Exhibit A-2. 3. Waive the application of the Streets and Highway Code 'Section 22613, and find that the exclusion of any parcels in this area from CSA 17 would deprive this area of needed services to ensure the health and safety of the residents of the area, and find that a waiver would not affect the ability of the City of Oroville to provide any service. 4, That the Butte County Public Works Director is hereby authorized to execute a letter agreement with the City of Oroville to provide a portion of the funds collected through CSA 17 to the City of Oroville in exchange for providing the services of CSA 17 to the parcels within the City limits. 5, That the application is categorically exempt from the requirements of the California Environmental Quality Act by CEQA Guidelines exemption 15319. 6That the Butte County Chief Administrative Officer is hereby authorized to execute and submit on behalf of the County of Butte an application and all other relevant documents to the Butte Local Agency Formation Commission to take proceedings for the annexation of South Oroville "Area-A" no sooner than 30 days from the date of this resolution if, an application is not submitted by the City of Oroville. 7. That LAFCo approval of the annexation shall be recorded when the proceedings have been completed. B. That the Clerk of the Board is authorized and directed to file a certified copy of this Resolution with the Executive officer of the Butte County Local Agency Formation Commission.
