AN TNTER.IM ORDINANCE ZONING A PORTION OF THE COUNTY
OF BUTTE AN "AR~-MH-~ 3 " (AGRICULTURAL RES IDENTTAL -
MOBILE ~iOP~E) DISTRICT

2 The Board of Supervisors of the County of Butte, State of
3 California under and pursuant to Ordinance No.-475, as amended,
,¢ and declaring an emergency, DO ORDAIN, as follows:
5 SECTION 1. The hereinafter described area situated in the
g County of Butte, State of California, shall ]ae and it is hereby
7 zoned as an "AR--MH-3" (Agricultural Residential - Mobile Home)
g District for a period of ~ 120 days, and such area shall be
9 subject to the restrictions and restricted uses and-regulations
10 hereinafter specified and provided. Said area so zoned being
11 located on Nimshew Ridge and particularly described as:
12 All that property located within one thousand (1000)
feet on either side of:
13
Magalia Nimshew Road centerline from Skyway to Humbug
14 Road (1.11; miles) ~ Humbug Road centerline from
Magalia-Minshew Road to Nimshew Ridge Road (0.5;~miles)
15 Nimshew Ridge Road centerline from Humbug Road to end
of Caunty maintained section of Nimshew Ridge Road
18 (2.43 miles)
17 containing 970 acres, more or less.
18 Excepting therefrom: All of "Paradise Pines, Unit
#14" per map recorded in map book 38 on Wages 37 & 41,

2.1 USES PEPNfTTTEDs
a. Single-family dwellings .
b. Mobile Homes ~ to house one family, when such ~~obile
Home is the only housing facility located on the
premises, provided the follo~•aing conditions are con-
formed to: ~
1. The gross area of the Mobile Home shall not be
Less than 5(?0 square feet.
2. All sanitary facilities shall conform to State
Statutes and regulations and to local require-
menu of the Butte County Health Department.
3. All electrical installations shall. conform to
State Statutes and regulations as administered.

c. Accessory buildings pertinent to the permitted uses.
d. Agricultural uses.
e. Lives tack, subject to requirements as fallotas:
1. For each horse or head of cattle over one (l)
year of age -~ eight thousand,one hundred twenty-
. five (8x125) square feet.
2 . For each head of swine over ten. (10 ) weeks of aqd
- eight thousand one hundred tt~~enty--five { 8x125}
square feet.
3. For each head of sheep ar goats -- two thousand

2.2 THE FOLLO~nTTNG USES SUBJECT TO SECU'~.ING A USE PERMIT
IN EACH CASE

a. Golf courses, country clubs, ?f permitted, would
permit accessory uses such as driving range, pro
shop, cocktail bar, restaurant.
b. Public and quasi-public uses including churchc-s,
firehouses, hospitals, parks and playgrounds, schools
and public utility buildings.
c. Livestock farming.
d. Veterinary clinics, outnat~.ent.
e. Nurseries and plant gardens .
2 .3 LOT AREA REQUIRED : A"inimum rCc(uired area of a lat
per dwelling unit shall be not less than three {3) acres.
2.4 LOT GdIDTH REQUIRED: 1~~inimum lot width shall be not
less than one hundred thirty {l30} feet.
2.5 >~RONT YARD REQUIRED: rdinimum front yard shall be nat
less than fifty {5D} feet from the centerline of the road, n~cept
where the road is classified by the County as a Federal Aid Sec-
ondary Road, the minimum building setback requirement shall be
fifty-five (55) feet from the centerline of the road.
2.5 SIDE YARD REQUIRED: Minimum side yard shall not be
less than ten (l0) feet.
SECTION 3. All uses of land within the district not
specifically authorized and aermitted in Section are prohibited.

this Ordinance in full.
SECTION 5, The penalties for .the violation. of t~~e zoning
hereby imposed within the district shall be as nravicl.ed in the
Zoning Enabling Ordinance. In compliance with the provisions of
the Zoning Enabling Ordinance, this Ordinance shall from and
after its effective date became a su?~plement to and part of the
Zoning Enabling Ordinance.
SECTION 6. This urgency ordinance shall take effect
immediately upon its passage, and before the expiration of fifteen
(15} days after its passage shall be published once with the
names of all members of the Berard of Supervisors voting f_ar and.
agains~,t the same in the Paradise Post , a newspaper
in general circulation in the County of Butte, State of California,
The facts constituting the urgency on which this Ordinance is
based are
~.. To allow time for completion of the comprehensive
~zoninq study for the area which is in progress.
2. This urgency ordinance is necessary to preserve the
public health, safety and welfare .in the subject area until said
comprehensive zoning study and rezoning is decided an.
