HomeMy WebLinkAbout1426ORDINANCE NO. 11.26 AN INT~;RIM ORDINANCE ZONING A PORTION OF TIDE COUNTY OF BUTTE AN "A-3° {AGRICULTURAL) DISTRICT, PURSUANT TO ORDINANCE NO. 475, A5 AMENDED 1 The Board of Supervisors o£ the County of Butte, States of 2 California, under and pursuant to Ordinance No. 475, as amended, 3 and declaring an emergency, DO ORDAIN as follows: 4 SECTION 1. The hereinafter described area situated in the 5 County of Butte, State of California, shall be and it is hereby 6 zoned as an "A-3" {Agricultural} District, for a period of 180 7 days, and such area sha11 be subject to the restrictions and re- S stricted uses and regulations hereinafter specified and provided. 9 Said area so zoned being located in the unincorporated area of 10 Butte County, California, west of Chaco, more particularly des- ~-I cribed as follows: 12 Beginning at the N~nT corner of Lot 9 of "~Iorehead Ranch Sub Na. 1" as recorded in map of record in 13 Book 9, Page 14, also being on the south right-~of- way line of Oak Park Ave.; thence east along the I4 north line of said Lot 9, 300 ft.; thence south parallel to the west Line of said Lot 9 to the south 15 dine of said Lot 9, also being the north line of Lot 12 of said subdivision; thence east to fiche NE corner 16 of said Lot l2; thence south along the east line of 17 said Lot 12 and its southerly prolongation to the NE corner of Lot 19 of said sub.; thence continuing 18 south along the east line of sand Lot 19, 286.94 ft.; ', thence east, para11e1 to the north line of Lot 19, Z9 423.18 ft. to the east line of Lot 20 of said sub- division; thence southerly along the easterly line 20 and southerly prolongation to its intersection with the south right-of-way line of Chico River Road; 21 thence westerly along said right-af--way line to the NW corner of Lot 1 of the "Mary E. Containing 235 acres, more or less. 5ECTION 2. REGULATIONS FOR AN "A-3" DISTRICT: The following regulations shall apply in an "A-~3" District: 2 .l USES PER~~ITTED a . Single--family dwellings . b. General. farming, horticulture, commercial livestock, poultzy production, warehousing and storage. c. Accessory buildings and uses pertinent to the permitted uses, including agricultural processing plants . d. Housing facilities (including mobile homes) to accamodate only agricultural employees and their families employed by the owner or operator of the premises; and provided further that such housing facility shall. be considered accessory to the main building and shall conform to the provision per-- taining to required yard and open space for dwelling: e. Mobile homes to house one family when such mobile home is the only housing facility located on the premisesy-provided the fallowing conditions are con- f ormed ta: ~. -2- 1 2i 3 4 5 B 7 8 9 10 Z1 7.2 13 14 15 18 17 18 19 20 2]. 22 23 24 23 28 1, The floor area within the mobile home shall not be less than five hundred (5~0~) square feet. 2. The parcel of land conforms to Section 2.3 (Mina-- mum lot area of 5 acres), or is a smaller parcel of land lawfully created prior to the enactment of the~Ordinance, subject to written approval by the Director of Planning. 2.2 THE FOLL06~TING USES SUBJECT TO SECURING A USE PERMIT IN EACH CASE: a. Golf courses and country clubs. b. Public or quasi-public uses including churches, fires houses, hospitals and clinics, parks and playgrounds, schools, public utility buildings and professional buildings . i 2.3 MINIMUM LOT AREA REQUIRED: ' Minimum lot area sha11 not be less than five (5) acres . 2.~ FRONT YARD REQUIRED: Minimum front yard shall be fifty (5©) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road and the, minimum building setback requirement shall be fif ty-five (55) feet from the centerline of the road. 2.5 SIDE YARD REQTi71RED: Minimum side yard shall not be less than five C5) feet. -3-- 1 2 3 4 5 6 7 8 9 10 13 12 13 34 15 16 17 18 19 20 2I 22 23 24 25 26 SECTION 3. All uses of land not specifically authorized and permitted under Section 2 are prohibited within the district. SECTION 4. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in Section 15 or Ordinance No. 475. In compliance with the provisions of the Zoning Enabling Ordinance, this ordinance shall from and after its effective date become a supplement to and part of the zoning Enabling Ordinance. SECTION 5. This urgency ordinance sha11 take effect im- mediately upon its passage, and before the expiration of fifteen (15) days after its passage shall.be published once with the names of all members voting far and against the same in the Chico Enterprise-Re card , a newspaper in general circulation in the County of Butte, State of California. The facts constituting the urgency on which this ordinance is based are: 1. To allow time for completion of a comprehensive zoning study for the west Chico area.
