AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY
OF BUTTE AN "AR MH" {AGRICULTURAL RESIDENTIAL 1VOBILE

The Board of Supervisors of the County of Butte, State of
_ _..
California, ~.nder and pursuant to Ordinance No. 475, as amended,
and declaring an emergency, DOES ORDAIN as follows:
SECTION 1. The hereinafter described area situated in
the County of Butte, State of California, shall be and it is
hereby zoned an "AR-MH" (Agricultural Residential-Mobile Home)
District for a period of 6°°0 days, and such area shall be sub
jest to the restrictions and restricted uses and regulations
hereinafter specif ied and provided. Said area so zoned being
located east of Oroville and described as:
A11 of Lots 173, 174, 175 & 178 of "Oroville Wyan-
dotte Fruitlands, Un~.t No. 5", per map filed in the
Office of Butte County Recorder, in Map Book 8 on
Page 37A, containing 75 acres, more or less.
SECTION 2. REGULATIONS k'OR AN "AR-M~~rDTSTRICT:
The following regulations shall apply in an "AR-MH"
District:
2.1 USES PERMITTED:
a . Single--family dwellings .
b. Mobile Homes - to house onefamily, when such
mobile home is the only housing facility located
on the premises, provided the following cond~.tions
are conformed to:
1} The gross area of the mobile home shall not be
less than 540 square feet.
2} All sanitary facilities shall conform to State

Statutes and regulations and to local require-
ments of the Butte County ~Iealth Department.
3) All electrical installations shall conform to
State Statutes and regulations as administered
by the Building Division of the Butte County
Public Works Department.
c. Accessory buildings pertinent to the permitted uses.
d. Agricultural uses.
e. Livestock, subject to requirements as follows:
1} Minimum lot area to be devoted to residential
use shall be not less than eight thousand,
one hundred twenty-five {8,125) square feet.
2) Exclusive of the area devoted to the residential
use, the following lot or parcel areas shall be
required for each animal raised or kept on the
premises:
a) For each horse or head o£ cattle over one
{1) year of age - eight thousand one hundred
twenty-five {8,125} square feet.
b) For each head of swine aver ten (10 ) weeks
of age - eight thousand, one hundred twenty-
five (8,1.25) square feet.
c) For each head of sheep or goats - two
thousand {2,000) square feet.
2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT
IN EACH CASE:

a. Duplex dwellings and multiple-family dwellings.
b. Golf courses, country clubs, if permitted, would
... _. ..
permit accessory uses such as driving range, pro
shop, cocktail bar, restaurant.
c. Public and quasi-public uses including churches,
firehouses, hospitals, parks and playgrounds,
schools and public utility buildings.
d. Commercial poultry farming and livestock farming.
e. Veterinary clinics, outpatient.
f. Nurseries and plant gardens.
2,3 LOT AREA REQUIRED: Minimum required area of lot per
dwelling unit shall be not less than eight thousand, one .'.
hundred twenty-five (8,125} square feet.
2.4 LOT WIDTH REQUIRED: P~inimum lot width shall be not
less than sixty-five (65} feet.
2.5 FRONT YARD REQUIRED: Minimum front yard shall be
fifty (50) feet from the centerline of the road, except
where the road ~.s classified by the County as a Federal
Aid Secondary Road, the minimum building setback require-
ment shall be fifty-five (55) feet from the centerline of
the read .
2.6 SIDE YARD REQUIRED: Minimum side yard shall be not
less than five (5) feet. ',
SECTION 3. All uses of land within the district not
specifically authorized and permitted in Section 2 are prohibited
SECTION 4. In compliance with the provisions of said

Zoning Enabling Ordinance, the same is hereby amended by adding
this Ordinance in full.
SECTION 5. The penalties for the violation of the zoning
hereby imposed within the district shall be as provided in the
Zoning Enabling Ordinance. In compliance with the provisions of
the Zoning Enabling Ordinance, this Ordinance shall from and
after its effective date become a supplement to and part of the
Zoning Enabling Ordinance.
SECTION 6. This urgency ordinance shall take effect
immediately upon its passage, and before the expiration of fifteen
(l5} days after its passage sha11 be published once with the
names of all members of the Hoard of Supervisors voting for and
against the same in the Oroville Mercury a newspaper in
general circulation in the County of Butte, State of California,
The facts constituting the urgency on which this Ordinance is
based are:
1. A petition for permanent rezoning will soon be con-
sidered by the Planning Comm~.ssion.
2. In order to preserve and maintain the area until
such time as the permanent zoning for the area is
heard .
PASSED AND ADOPTED by the Board of Supervisors of the
County of Butte, State. of California, on the I9th day of
February 1974 , by the following vote:
AYES: Supervisors Cameron, Gilman, Ladd, McKillop and Chairman Madigan
