II _.~,_1 d Es1_ - ~, AN INTERIM OR17TN~ICE ZONING A PORTION OF THE COUNTY OF BUTTE AN "A-3" (AGRICULTURAL} DISTRICT, PURSUANT TO ORDINANCE NO. 475, AS AMENDED 1 The Board of Supervisors of the County of Butte, State of 2 California, under and pursuant to Ordinance No. 475, as amended, 3 and declaring an emergency, DOS, ORDAIN as follows: 4 SECTION 1. They.hereinafter described area situated in the 5 County of Butte, State of California, shall be and it is hereby B zoned as an "A-3" (Agricultural} District, for a period of 120 7 days, and such area shall. be subject to the restrictions and re- $ • stricted uses and regulations hereinafter specified and provided, 9 Said area so zoned being boated in the unincorporated area of 10 Butte County, south of Oroville, more particularly described as 11 follows: 12 That portion of Sections 17 and 20, Tl$N, R4E, located west of the Southern Pacific Railroad 13 right-of-way, and east df the Western Pac~.fic l4 Railroad right--of way. Excepting the N~ of the N'~ of said Section 17; and also Excepting therefrom the southeast 4 of the 15 southwest ~ of said Sec 20 and that portion of the southwest ~ of the southeast ~a.of said Sec 20 16 located west of said ~puthern Pacific Railroad 17 right-of-way, Containing 309 .3 acres . ],g SECTION 2. REGULATIONS FOR AN "A-3" DISTRICT: The 19 following regulations shall apply in an "A-3" D~.strict: 20 2.1 USES PERMITTED: ~~ 21 a. Single-~family dwellings. 22 b. General farming, horticulture, commercial livestock, 23 poultxy production, warehousing and storage. 24 c, Accessory buildings and uses pertinent to the 25 permitted uses, including agricultural processing 26 plants . /yGp/ ~. d. Housing facilities (including mob5.le homes) to 2 accomodate only agricultural. employees and their 3 families employed by the owner or operator of the 4 premises; and provided further that such housing S facility shall. be considered accessory to the main B building and shall conform to the provision per- ? taining to required yard and open space for dwellings 8 e. Mobile homes to house one .family when such mobile 9 home is the only housing facility located on the 10 premises, provided the following conditions are con- ~ 11 formed to : 12 1. The floor area within the mobile home shall not 13 .. be less than five hundred (500) square feet. 14 2. The parcel of land conforms to Section ~.3 (Mini- 15 mum lot .area of 5 acres), or is a smaller parcel 16 _.._ of land lawfully created prior to the enactment 17 of the Ordinance, subject to written approval 18 by the Director of Planning. 19 2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT 20 IN EACH CASE 21 a. Golf courses and country clubs. 22 b . Public or quasi.--public uses including churches, fire 23 houses, hospitals and clinics, parks and playgrounds, 24 schools, public utility buildings and.professir~nal 25 builc~.ngs . 26 2.3 MINIMUM LOT AREA REQUIRED: -2- 1 Minimum lot area shall not be less than five {5) 2 acres. 3 2.4 FRONT YARD REQUIRED: 4 Minimum front yard shall be fifty (50) feet from the 6 centerline of the road, except where the road is 6 classified by the County as a Federal Aid Secondary 7 Road and the minimum building setback requirements 8 shall. be fifty-five (55} feet from the centerline 9 of the road . 10 2.5 SIDE YARD REQUIRED: 11 Minimum side yard shall not be less than five (5)' 12 feet . 13 SECTION 3. All uses of land not specifically authorized 14 and permitted under Section 2 are prohibited within the district. 15 SECTION 4. The penalties for the violation of the zoning 16 hereby imposed within the district shalt be as provided in Sectinn 17 15 or Ordinance No. 475. in compliance with the provisions of the 18 Zoning Enabling Ordinance, this ordinance shall from and after ~9 its effective date become a supplement to and part of the zoning 20 Enabling Ordinance. 21 SECTION 5. This urgency ordinance shall take effect 22 immediately upon its passage, and before the expiration of fifteen 23 ~(1'S} days after its passage shall be published once-with the names 24 of all members for and against the same in the oroyil~e ~ Mercury a newspaper in general circulation in the 2B County of Butte, State of California.
