HomeMy WebLinkAbout1463ORDINANCE N0. 1463 AN INTERIM ORDINANCE ZONING A PORTION OF T.HE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "A-2 LIMITED" DISTRICT 1 2 3 4 6 B 7 S 9 10 ~i ~.2 13 34 15 16 ~7 18! as 20 21 2~ 23 24 28 The Board of Supervisors of the County of Butte, State of California under and pursuant to Ordinance No. 47~, as amended, and declaring an emergency, DDES ORDAIN, as follows: SECTION 1. The hereinafter described area situated in the County of Butte, State of California, shall be and it is hereby zoned as an "A~2 Limited" District for a period of 120 days, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area sa zoned being located north of Paradise, particularly described as: PARCEL 1 All that property on both sides of and within 660 ft. of the centerline of Skyway from the intersection of "Old Skyway" and "New Skyway" said intersection being approx. lj4 ft. south of Cedar Lake Drive, to Rosewood Drive, also all the property immediately south of said intersection, identified as AP 64-66-26, AP 64-66-27, AP 64-66-28, AP 6~-21-17 and AP 6~-2j-01, per maps on file as of March 1, 1974, in the Office of the Butte County Assessor; Excepting therefrom any portion of "Paradise Pines, Unit No. 5" per map of record in Map Book 35 on Pages 88 through 91; PARCEL 2 All of "Paradise Pines Commercial Park" per map of record in Map Book 38 on Pages lj and 16; .PARCEL '3 All of "Skyway Plaza" per map of record in Map Book 48 on Page 03. Containing 141 acres, more ar less. SECTION 2. Lawful uses of land now established. b, Single-family dwellings and accessory buildings. c. Agricultural uses and buildings. 2.3 USE PERMITS REQUIRED: No multiple-family dwellings, commercial uses of land or buildings, industrial uses of~land or buildings, mobile home parks, recreational vehicle parks, campsites, public or quasi- public uses including schools, churches, public buildings, public utility buildings will be allowed without first securing a use permit approved by the Planning Commission. 2.~ MINIMUD~ SETBACK REQUIREDs Fifty (j0) feet from the centerline of the road, except where road is classified as a Federal Aid Secondary, then the minimum setback shall be fifty-five (55) feet from the center- line of said road. 2.j BUILDING SITE AREA REQUIREMENT: Each single-family residence shall be heated on a site not less than eight thousand, one hundred and twenty-five (8,12j) square feet. 2,Ea SIDE YARD REQUIREIv~NTS: The minimum-'side yard shall not be less than five {~) feet, 2.7 REAR YARD REQUIREMENTS: -~, 1 2 3 4 6 8 7 8, 9 xO Il 12 13 14 15 16 ~,7 18 19 20 21 22 23 24 25 26 The minimum reax yard sh^11 ~~ot be Less than five { j) feet. 2.~ OFF-STREET PARKING REQUIREMENTS: Two (~} parking spaces fo.r each living unit, or one {1) parking space for each three {3} employees, or one (1) park- ing space for each two thousand {2,040) square feet of gross flaar space, whichever is greater. 2.9 TRUCK LOADING AND UNLOADING SPACE: Private off-street loading space for the handling of ail. goods, materials and equipment shall be provided. Such spec.e shall be of sufficient area and of such design as to permit the parking and unloading of vehicles without extending into any existing street beyond the curb line. 2.10 In cases where compliance with provisions of this section will. result in undue hardship, a variance may be approved in said manner prescribed in the handling of a use permit. SECTION 3. All uses of land within the district not specifically authorized and permitted in Section 2 are prohibited. SECTION 4. Tn compliance with the provisions of said Zoning Enabling Ordinance, the same is hereby amended by adding this Ordinance in full. SECTION 5. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Zoning Enabling Ordinance. Tn compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. -3- 1 SECTION '~. This urgency ordinance shall take effect 2 immediately upon its passage, and before the expiration of fif- 3 teen (lj} days after its passage shall be published once with the 4 names of they members of the Board of Supervisors voting for and 5 against the same in the Chico Enterprise-Record , a newspaper g in general circulation in the County of Butte, State of Cali- ? forma. The facts constituting the urgency on which this Ordi- g nanoe is based are g 1. That the area is presently under study for rezoning. 10 2. To be more consistent with the present land use.
