The hereinafter described area situated in the' County of Butte, State of California, shall be and it is hereby zoned as an "A-3" (Agricultural) District, for a period of 180 days, and such-area shall be subject to the restrictions and re- stricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County, California, west of Chico, more particularly des- cribed as follows: Beginning at the NW corner of Lot 9 of "Morehead Ranch Sub No. 3" as recorded in map of record in Boak 9, Page 14, also being on the south right-of- way line of Oak Park Ave.; thence east along the north line of said Lot 9, 300 ft.; thence south parallel to the west line of sand Lot 9 to the south line of said Lot 9, also being the north line of Lot 12 of said subdivision; thence .east to the NE corner of said Lot 12; thence south along the east line of said Lot 12 and its southerly prolongation to the NE corner of Lot 19 of said sub..; thence continuing south along the east line of said-Lot 19 , 2 85.94 ft . ; thence east, parallel to the north line of Lot 19, 423.18 ft. to the east line ,of Lot 20 ~~ said sub- division; thence southerly along tkse easterly line and southerly prolongation to ~.its~.:;intersection with the south right-of-way line of .:Chico River Road; thence westerly along said rightMof way line to the Nw corner of Lot 1 of the "Mary E.-O'Connor Sub." as retarded in map of record in~--Book S, Page 19 in the office of the Butte County Recorder; thence north along the northerly prolongation of the west line of Lots 1, 2, 3, 4, 5, 6 and 7 of~sa.id Sub., also being the east right-of way line'of Chico River Road, to the south lane of Lot 54 ofr""-Morehead Ranch Sub. No . 2 " as recorded in map of icecord' in Book 10 , pages /'yG~ 1 2 3 4 5 6 7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 2B 8 & 9; thence west along the south line of Lots 52, 53 & 54 of said Sub. to the SW corner of said Lot 52; theme north along the west line and its northerly prolongation to the south line of Lots 40 and 41 of said sub., also being the north sight-of~-way l~:ne of Santa Clara Ave.; thence west along said lot line to the SW corner of said Lot 41; thence north along the west line of Lots 34 and 41 of said Sub. to the NW corner of said Lot 34 , also being on the south right-of--way. line of oak Park Ave.; thence east along said right-of-way line to the point of begin- ning; Exc~l:uding therefrom that property identified as AP 42-19-18 and AP 42-19-19, per assessment roll of March 1, 19'74, of the Butte County Assessor; Containing 232 acres, more or less. SECTION 2. REGULATIONS FOR AN "A-3" DTSTRTCT: The following regulations shall apply in an "A-3" Distr~.ct: 2.1 USES PERMITTED; a. Single-Family dwellings . b. General farming, horticulture, commercial livestock, poultry production, warehousing and storage. c. Accessory bua.ldings and uses pertinent to the permitted uses, including agricultural processing plants . d. Housing facilities (including mobile homes) to accomodate only agrcultural.emplgyees and their families employed by the owner or operator of the premises; and provided further that such housing facility shall be considered accessory to the main building and shall conform to the provision per- tanning to required yard and open space fvr dwellings -2- 1 2 3 4 5 6 7 8 9, 14 I' 11 12 13 l4 15 16 17 18 is 20 21 22 23 24 25 26 e. Mobile homes to house one family when such mobile home~'is the only housing facility located on the premises. provided the following conditions are con- formed to: 1. The floor area within the mobile home shall not be less than five hundred (500} square feet. 2. The parcel of land conforms to Section 2.3 (Mini- mum lot area of 5 acres), or is a smaller parcel of land lawfully created prior to the enactment of the Ordinance, subject to written approval by the Director of Planning 2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT TN EACH CASE: a. Golf courses and country clubs. b. Public or quasi public uses including churches, fire houses, hospitals aifd clinics, parks and playgrounds, schools, public utility buildings and professional buildings. 2.3 MINIMUM LOT AREA REQUIRED: Minimum lot area shall not be less than five {~) acres . 2.4 FRONT YARD REQUIRED: Minimum front yard shall be fifty { 50} feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road and the minimum building setback requirement _g- 1 2 3 4 5 6 7 8', 9' 10 11 12 13 14 15 16 27 18 19 20 21 22 23 24 25 26 shah. be fifty-five {55} feet from the centerline of the road. 2.5 51DE YARD REQUIREDr __ Minimum side yard shall not be Tess than dive (5} feet SECTION 3. All uses of land not specifically authorized and permitted under Section 2 are prohibited within the district. SECTION 4. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in Section 51 of Ordinance No..4.75. In compliance with the provisions of the Zoning Enabling Ordinance, this ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 5. This ux'gency ordinance shall take effect im- mediately upon its passage, and before the expiration of fifteen (15) days after its passage shall be published once with the names of all members voting for and against the same in the a newspaper in general circulation in the County of Butte, State of California. The facts constituting the urgency on which this ordinance is based are: 1. To allow time for completion of a comprehensive zoning study for the west Chico area.
