I48I 1 2 3 4 5 B 7, S' 9 10 11 12 13 J.4 15 16 17 18 19 20 21 22 23 24 2S 26 AN ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, 5"TATE OF CALIFORNIA, CALLING AND PROVIDING FOR A SPECIAL COUNTY CHARTER ELECTION FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTOR 5 OF SAID COUNTY THE PROPOSITION OF WHETHER OR NOT CERTAIN SPE GIFTED AMENDMENTS OF THE CHARTER OF THE COUNTY OF BUTTE SHOULD BE APPROVED: FIXING THE DATE OF SAID ELECTION AND THE MANNER OF HOLDING THE SAME AND THE PROCEDURE FOR VOTING FOR OR AGAINST SAID AMENDMENTS: PROVIDING FQt NOTICE OF SAID ELECTION: AND CONSOLIDATING SAID SPECIAL COUNTY CHARTER AMENDMENT ELECTION WITH THE STATE GENERAL ELECTION TO BE HELD ON NOVEMBER 5, 1974 The Board of Supervisors of the County of Butte, State of California, DOES ORDAIN as follows: Section 1(a}. A special election is hereby called to be held throughout Butte County on Tuesday, the fifth day of November, 1974, for the purpose of submitting to the qualified voters of the County, the proposition of rev isir~g the Charter of the County of Butte in the following particulars: That Section 7 of Article IV of the Butte County Charter be amended to read as follows: Section 7. The offices of such assistants, deputies, clerks, stenographers and other necessary employees are hereby created. The incumbents shall be appointed and be subject to removal pursuant to the provisions of a merit system to be established by ordinance by the Board of Supervisors, The number of such offices or the salaries of such assistants, deputies, clerks, stenographers and other necessary employees may be increased or decreased by the Board of Supervisors at such times as may be to the best interest of the county, and such salaries sha11 be paid to them at the same time, in the same manner, and out of the same fund as the salaries of the ...... /'y~i 1 county officers are paid, except as in this Chapter otherwise 2 provided. 3 That Section 7.5 of Article TV o£ the Butte 4 County Charter be added to read as follows: 5 Section 7.5. The merit system shah: include 6 all county employees except those specifically exempted by the 7 Board of Supervisors. Said merit system shall provide for $ analyzing and classifying jobs; establishing adequate and 9 equitable salary, fringe benefits and retirement plans; projecting 10 manpower needs and planning to meet them; developing effective 11 recruitment, selection, placement, training, employee evaluation 12 and promotion programs; assuring equal opportunity and providing 13 affirmative action programs to achieve that end; protecting employE 14 from discrimination, arbitrary removal, and political pressures; 15 conducting positive employee management relations and cammvnicatio n: 18 and providing research to improve personnel methods. All non- 17 elected county officers and department heads shall be subject to 18 appointment and removal from office directly by and at the 19 discretion of the Board of Supervisors. 20 Section 1(b}. P. in Ordinance- No . 1481 Amends Article 1V, Section 7 of the Butte County Charter, and adds Section 7.5 to Article 1V of the Butte County Charter, as provided in Ordinance 1 5! ~' 1 of Butte County YE S NO Section 2(a). This Board does hereby submit to the qualified electors of the County at the special county charter amendment election said county measures for the revision of the Charter of the County of Butte, and hereby designates and refers to said measures in the form set forth in Section 1{b) hereinafter prescribed for use at the special county charter amendment election. Section 2(b). The special county charter amendments election consolidated with the State General Election shall be held and conducted, and the votes thereat received and canvassed, and the results thereof made and the results thereof ascertained and determined as herein provided, and in all particulars not prescribed by this resolution and order said election shall be held as nearly as practicable in conformity with the election laws of the State of California and only qualified voters of the County may vote thereat. 3. 1 2 3 4 5 6 7 8 9 10 11 ].2 13 14. 15 16 17 18 ~s 20 2Z 22 23 24 25 26 Section 2{c). The special county charter amendment election hereby called shall be and is hereby consolidated with the State General Election to be held throughout the County on November 5, 1974, all as required by and pursuant to law; and the election precincts, polling places and voting booths shall in every case be the same and there shall be only one set of election officers in each of said precincts. The election precincts, polling places and officers of election for this special county charter amendment election shall be as follows: The polls for said special charter amendment election shall be opened at 7.00 a.m. on the date of said elections and shall be kept open until 8:00 p.m. on said day, when the polls shall be closed except as provided in Elections Cade Section 14436. Section 2(d). Only one form of ballot shall be used at said General Election and the special county charter revision election hereby consolidated therewith, which in addition to all other matters required by law to be printed thereon, shall state the measure set forth in Section l(b) hereof. Votomatic ballot cards are to be used at said election. Each voter to vote for the measure hereby submitted and for revising the Charter of the County of Butte as therein stated shall punch the ballot card in the hole after the word "YES" to the right of said measure, and to vote against said measure and against revising the Charter of the County of Butte as therein stated shall punch the ballot card in the hole after the word "NO" to the right of said measure. 4. 1 2 3 4 6 6 7 8 9 10 11 12 ~ 13 ; ].4 . 15 IB 1'7 18 19 20 21 22 23 24 Section 2(e). The County Clerk of the County shall supply ballots and stationery and all other things necessary 'for the conduct of said elections to the proper officers of elections. Section 2{f). The provisions of Article 3 of Chapter 2 of Division 4 of the Elections Code shall apply to said special ~i county charter amendment election and the County Counsel shall ~' prepare an analysis of said county measures in the manner provided in Elections Code Section 37$1. Section 2{g}. The returns of said elections shall be made out and signed by the election officers and shall be by them deposited with the County Clerk, together with the ballots cast at said elections, and the said returns shall be canvassed or caused to be canvassed by the Board which shall declare the results of said elections at the time and in the manner provided by-law. Section 3. Pursuant to Government Code, Sections 23722 and 23709, the Clerk is hereby ordered to have the proposed charter amendments, as contained in Section 1(a) of this ordinance, published ten {10) times on ten (10} different days in the following named newspaper, to wit : aroyi~J.e Mercury (which the Board hereby finds and declares to be a daily newspap of general circulation printed, published and circulated in the County}o The first such publication shall be as soon after the 26 ..... 28 5. ~, adoption of this ordinance as is possible and in no event later 2 than they 15th day after the enactment of this ordinance, The 3 last such publication sha11 be between September 16th 1974 4 and September ,2gth ,_, 1974. b Pursuant to Government Code Section 23731, the Clerk g is hereby ordered to have this ordinance published five (5) 7 times on five (5) different days, prior to the herein set election 8 in the follow~.ng named newspaper, to wit : Oroville Mercury ~~ 9 (which the Board hereby finds and declares to be a daily newspaper la of general circulation printed, published and circulated in the 11 County.) 12 No notices of the election hereby called, other than 13 those specified in Section 3~of this ordinance, need be given. 34 Section 4.
