HomeMy WebLinkAbout1491ORDINANCE NO. 1491 1 2 3' 4 S: 6 "! 8 9~~ 10 I1: 12. 13 14 15 18 '~ 17- 18 19 20 2Z 22 23 24 25 28 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN AR-MH (AGRICULTURAL- RESIDENTIAL-MOBILE HOMEY DISTRICT, PURSUANT TO ORDINANCE N0. 47'5, AS AMENDED, The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No, 475 of said Count, being the Zoning Enabling Ordinance of said County, as amended, DO ORDAIN as follows: SECTION 1. The hereinafter described area, situated in the County of Butte, State of California, shall be and it is hereby zoned as an "AR-MH" (Agricultural Residential - Mobile Home District, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and pro- vided. Said area so zoned-being located in the unincorporated area of Butte County, west of Oroville, California, more particu- larly described as follows: Lots 1.', ' 2, 3 , 6 and 8 of Block 17 of "Villa Verona Sub . " per M.D.R. Wall Map No. 12 of the Butte County Recorder; and Lots-~. and 3 of Block 6 of said "Villa Verona Sub."; and also the easterly 198 feet of Lot 2 and the norther- ly 12 6 ft . of the southerly 378 f t. of Lot 4 , of said Block 6 of said "Villa Verona Sub.", containing approx. 39 acres. SECTION 2. REGULATIONS FOR AN "AR-MH" DISTRICT: The following regulations shall apply in an "AR-MH" District: 2.1 USES PERMITTED a. Single-family dwellings. b. Mobile Homes - to house ane family., when such mobile home is the-only. housing facility located on the premises, provided the following conditions are conformed to: -1- 1 2' S' 4. fi 6 7 8' 9 lO ].1 12 13 14 15 16 17 18 19 20 21 22 23 24 23 2B l) The Bross area of the mobile home shall not be less than 500 sq. ft. 2) All sanitary facilities shall conform to State Statutes and regulations and to local require- ments of the Butte County Health Department. 3) All electrical installations shall conform to State Statutes and regulations as administered by the Building Division of the Butte County Public Works Department. c. Accessory buildings pertinent to the permitted uses. d. Agricultural uses. e. Livestock, subject to requirements as follows: 1} Minimum lot area to be devoted to residential use shall be not less than eight thousand, one hundred twenty-five (S,i25) sq. ft. 2} Exclusive of the area devoted to the residential use, the following lot or parcel areas shall be required for each animal raised or kept on the premises: a) For each horse or head of cattle over one {1) year of age -eight thousand one hundre twenty-five {$,125) , sq. ft. b) For each head of swine over ten {l0) weeks of-age - eight thousand, one hundred twenty five (8,125) sq. ft. .. c) For each head of Sheep or goats - two i° 2 3` 4 5. 6 7 8: 9 10 1 ]. 12 13 14 15 16 17~ 18 i9 ~' 20 2Z 22 23 24 23 28 thousand (2,QOQ) sq. ft. 2.2 THE FOLLOWING USES SUBJECT TO SECURxNG A USE PERMIT IN EACH CASE: a. Duplex dwellings and multiple--family dwellings. b. Golf courses, country clubs, if permitted, would permit accessory uses such as driving range, pro shop, cocktail bar, restaurant. c. Public and quasi-public uses including churches, firehouses, hospitals, park s. and playgrounds, schools, and public utility buildings, d. Commercial poultry farming and livestock farming. e. Veterinary clinics, outpatient. f. Nurseries and plant gardens. 2.3 LOT AREA REQUIRED: Minimum required area of lot pe dwelling un~.t shall be not less than. eight thousand, one hundred twenty--five (8,125) sq. ft. 2.4 LOT WIDTH REQUIRED: Minimum lot width shall be not less than sixty-five (6S) ft. 2=.5 FRONT YARD REQUIRED: Minimum front yard shall be fifty {503 ft. from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum building setback requirements shall be fifty-five (55 ft. from the centerline of the road. 2.6 SIDE YARD REQUIRED: Minimum side yard shall not be less- than five (5) ft. SECTIQN 3. All uses of land within the district not -3- 1` 10 11 12. 13 I4 15 1B 17 1$ 19 . 20 '' 2I 22 23 24 2~5 28 specif ically suthorized and permitted in Section Z are prohibited. SECTION 4. In compliance with the provisions of the Zoning Enabling Ordinance, the same is hereby amended by adding this Ordinance in fu11, SECTION ~. The penalties for the violation of the zonin hereby imposed within the district shall be as provided ix the zoning Enabli~ig Ordinance. In compliance with the provisions of the zoning Enabling Ordinance, this ordinance shall be from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 6. This ordinance shall be and it is hereby declared to be in full force and effect from and after thirty {3(f} days .after. the date of its passage, and before the expiration of fifteen {15) days after `'its. passage, this ordinance shall be pub- . fished once with the names of the members of the Board of Super- visors voting for and against it in the Oroyi.l,le Mercury a newspaper published in the County of Butte, State of California.
