The hereinafter described area situated in . 6 the County of Butte, State of California, shall be and it is here- ? by zoned as a "TM-2~" (Timber Mountain) District, and such area 8 shall be subject to the restrictions and restricted uses and re- ~ gulations hereinafter specified and provided. Said area located 10 in the Magalia-DeSabla area, more particularly described as II' follows: I2 ~~ The S'~ of the SW~ of the NEB o~ Sec 11, T23N, R3E, MDB&M 13 ~ ` ~ Containing 20 acres, more or less . I4 SECTION 2. REGULATIONS FOR A-~~~M-2~ DISTRICT: The 15 following regulatigns shall apply in a TM-2~ District: 18 2.1 USES PERMITTED: 17 a. Single-family dwellings, including mobile homes. 18 b. Management, raising, harvesting and removal of trees x9` shrubs, seedlings, flowers, herbs and all food crops 20 for human or animal consumption. 2I c, Keeping and raising small animals for domestic use, 22 including dogs, cats and household pets, poultry and 23 other birds, bees, fish and frogs. 24 d. USES PERMITTED SUBJECT TO FIRST SECURING A USE PER- MIT IN EACH CASE: Residential uses other thaw one.~i.ngle-family dwell- ing per parcel or one single family dwelling per two and one-half (2~) acres, including labor camps, ca~nmercial-guest lodging, group quarters or dwelling units at greater densities. b. Mining, quarrying and excavating activities which 4 might be objectionable by reason of noise, odor, :. 6 smoke, dust, bright light~-~vibration, st2eam.pollu- ~ tion or handling of explosives or dangerous material 7. g. Commercial boat ramps, docks and..landing facilities. 8 h. Aircraft landing facilities. 9 i. Disposal areas and sewage treatment facilities. 10 j . Public and quase-public uses incle~cl~ing schools, park ~~- playgrounds, recreational facilities, utility system 12 structures, meeting halls, hospitals, libraries, 13; museums; government off ices and similar uses. 14 k. Private or commercial outdoor recreation facilities 15 on sites of not less than five (S) acres, including lfi, country clubs, golf courses, riding academies and 17` stables, hunting and fishing camps and other clubs, 18s and gun clubs and ranges. ~'~ ~ Z . 3 LOT AREA: 20 Minimum required area of a lot per dwelling unit 21' shall not be less than two and one half (2~) acres. 22 2.4 LOT WIDTH REQUIRED: 23 Minimum required lot width shall not be less than 24 sixty-five ( 6 5 ) feet . ~ 2.5 FRONT YARD REQUIRED: 26 Minimum required front building setback shall be -3- ~. 1. 2. 3 4` 5 6 7 8 9' 10: 11 12 13, 14 15 16 17 18 19 2d 21` 22~ 23' 24. 26 2B not less than fifty (5D) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum required front building setback shall be not less than fifty-five (55) feet from- the centerline of .the road. 2.6 SIDE YARD REQUIRED: Minimum required side building setback shall be not less than five t5) feet for "TM-2~. 2.7 REAR YARD REQUIRED: Minimum required rear building setback shall not be less than five t5) feet for ~"TM-2~" . SECTION 3. All uses of land not specifically authorized and permitted under Section 2 are prohibited within the district. SECTION 4. In compliance with the provisions of the Zoning Enabling Ordinance the same is hereby amended by adding , this ordinance in full. SECTION 5. The penalties for the violation of the x hereby imposed within the district shall be as provided in the Zoning Enabling Ordinance. SECTION 6. This ordinance shall be and it is hereby declared to be in full force from and after thirty (34) days after the date of its passage and before the expiration of fifteen (15) days after its passage this ordinance shall be published once with the names of the members of the Board voting for and against it in the Paradise Post , a newspaper published in the -4 - 1 2 3 4: S 6 7 8 9 10 11 12 13 14 15' 18: 17 18` 19 20' 21 22 23: 24 2.6 28 County of Butte, State of California.
