AN ORDINANCE BONING A PORTION OF THE COUNTY OF
BUTTE, STATE OF CALIFORNIA, A TM-40 (TIMBER-
MOUNTAIN) DISTRICT, PURSUANT TO ORDINANCE N0.
475, AS AMENDED
The.Board.of Supervisors. of .the C-aunty of Butte.,..State,
of California, under and pursuant to Ordinance No. 475, as amended
DO ORDAIN as follows:
aE~T~ON 1. The hereinafter.described.area situated in
the County of Butte., State of California, shall be and it is here-
by zoned as a TM-40 (Timber-Mountain) District, and such area shal
be subject to the restrictions and restricted uses and regulations
hereinafter specified and provided. Said' area located in the~-_ ~::~ ~:..
Magalia-DeSabla area, more particularly described as:
A portion~of the W~ of the NE4 of Sec 12, T23N, R3E,
MDB&M lying north of the following described line:
Beginning at a paint on the.northsouth centerline
of Sec 12, T23N, R3E, MDB&M located..3.4fl .fl. ft. north of
the center of said Sec 12; thence S 600 14' 45" E, 489.
54 f.t;. _thence N 61° fl3' 44'' E, 4.85.63 ft; thence N 850
27' Sfl" E, 487.13 ft. to the east line of the W'~ of the
NE4 of said Sec 12 and the end of said described line.
Containing 71 acres, more or less.
SECTION 2. REGULATIONS FOR A TM-40 DISTRICT: The
following regulations shall apply in a TM-40 District.
2.1 USES PERMITTED

Single-family dwellings, including mobile homes.
Management, raising, harvesting and removal of tree
shrubs, seedlings, flowers, herbs and all food crop
for human or animal consumption.
c. Keeping and raising small animals for domestic use,

including dogs, cats and household pets, poultry
and other birds, bees, fish and frogs.

d. Keeping, raising and pasturing of cat~.].e, horses,
sheep, goats, hogs or other livestock, provided
that no more than two (2) such animals be kept per
acre on parcels of less than five (5) acres and no
more than four {4) such animals be kept per acre
on parcels of five (5) acres or more,
e. Prospecting, claiming., drilling, mining, excavating!
and dredging of mineral, hydrocarbon and geothermal.

f. Protection of land and forests from fire, erosion,
floods, slides, quakes, ins.ects, --diseas-es-and pollu
tion, including arboretums and natural wilderness,

mary and pertinent to permitted uses, except as
limited in 2.2, including guest houses, barns,

2.2. USES PERMITTED SUBJECT TO..~'IRST SECURING A USE
PERMIT.. IN EACH CASE:
a. Residential uses other than .one _single-family
dwelling per parcel or one single family dwelling
per fourty (4Q ) acres for. "TM-~40 " .

including labor camps, commercial guest lodging,
group quarters or dwelling units at greater densi-
ties .
b. Commercial wood processing plants.
c. Commercial kennels and animal hospitals.
d. Commercial livestock feed yards.
e. Animal product processing plants.
f. Mining, quarrying and excavating activities which
might be objectionable by reason of noise, odor,
smoke, dust, bright light, vibration, stream pollu-
tion or handling of explosives or dangerous material
g. Commercial boat ramps, docks and landing facilities.
h. Aircraft landing facilities.
i. Disposal. areas and sewage treatment facilities.
j. Public and quasi-public uses including schools.
parks, playgrounds, recreational facilities, utili-
ty system structures, meeting halls, hospitals,
libraries, museums, government offices-and similar
uses.
k. Private or commercial outdoor recreation facilities
on sites of not less than five (~} acres, including
country clubs, golf courses, riding academies and
stables, hunting and fa.shing camps and other clubs,
and gun clubs and ranges.
2 .3 LOT AREA

shall not be less than forty (40) acres for "TM-40" .
2 . S FRONT YARD REQUI-RED
Minimum required front building setback shall be not
less than fifty (50) feet from the centerline of the
road, except where the road is classif ied by the
County as a Federal Aid Secondary Road, the rnin~.mum
required front building setback shall be not less
than fifty-five (55) feet from the centerline of
the road .
2.5 SIDE YARD REQUIRED:
Minimum required side building setback shall be not
less than twenty-five (25) feet for "TM-40" .
2.7 REAR YARD REQUIRED:
Minimum required rear building setback shall be not
less than fifty (50) feet for "TM-40".
SECTION 3,~ All uses of land not specifically authorize
and permitted under Section 2 are prohibited within the
district.
SECTION ~. In compliance with the provisions of the
Zoning Enabling Ordinance the same is hereby amended by adding
this ordinance in full.
