PROPOSED ORDINANCE AMENDING AGRICULTURE
BURNING GUIDELINES AND ADDING THERETO
PROVISIONS PERTAINING TO THE BURNING OF

The Board of Supervisors of the County of Butte, State of
California acting pursua nt to its authority as the Air Pollution
Control Board of the Butte County Air Pollution Control District
and pursuant to the provisions of §§24260 and 39298.8 of the
Health and Safety Code DO ORDAIN as follows:
That the following amendments and additions are made to the
rules and regulations of the Butte County Air pollution Control
District to implement the agricultural burning guidelines adopted
by the Sacramento Valley Air Basin Coordinating Council on June
28, 1974.
I. Sections 3-11 and 3-12 of Chapter 3 of the Rules and
Regulations of the Butte County Air Pollution Control District,
which sections were originally enacted by Ordina nce Noo 1197 anal

amended by Ordinance Noo 1312 are hereby amended to read as foil
Section 3-11a wing Period Required - Except as
provided for in Section 3-11x2 of these Rul es and Regulations,
to lower the moisture content of agricultural waste, the elapsed
time between cutting, felling or uprooting and ignition or burning
shall be:
1o A minimum of thirty (30) days for trees, stumps, and
branches greater than six {6) inches in diametero
20 A minimum of fifteen (15) days for vines or bushesq
Section 3-12. Ignition Hours - Except as provided for
in Section 3-l201 herein permits sha11 specify the hours from
7:45 a.mo to one {1} hour before sunset for ignition of fires,
and no person shall knowingly ignite agricultural waste, or permit

the ignition of agricultural waste under his control, on land u
his control. or by employees or other persons under his control,
except during these hours,
3:7o Section 3-11.2 and 3-1201 are added to Chapter 3 of the
Rules and Regulations of the Butte County Air Pollution Control
District to read as follows:
Section 3-3.102 - Rice Straw Burning - the following shall
apply to all rice straw and stubble burning:
1. All rice harvesters shall employ a mechanical straw
spreader to insure even distribution of the straw, with the excep-
tion that rice straw may be left in rows providing that it meets
the drying time criteria prior to a burn as described in this
section.
2a The drying time after harvest .shall be not less than
~~ three days and no row rice straw shall be burned prior to a ten
day drying time, except that if the rice straw or stubble makes
an audible crackle when tested just prior to burning with the
testing method described in this sectiono After a rain exceeding
15/100 of an inch rice straw or stubble shall not be burned
unless the straw makes an audible crackle when tested just prior
to burning with the testing method described in this section.
3o When checking the field far moisture the grower shall
test a composite sample of straw from under the mat, in the center
of the mat and from the different areas of the field to insure a
representative sample. A handful of straw from each area will
give a good indication.

Section 3 -12 0 ~. o Burning Hours for Rice~Straw - No
ignition of Rice Straw or stubbl~e~burning shall commence before
10:00 a.mo nor after 5:00 pom, in any day.
III. That this Ordinance shall take effect thirty (30) days
after the date of its adoption and before expiration of fifteen
(15) days after its passage shall be published with the names and
members of the Board of the Butte County Air Pollution Control
Board voting for and against in a newspaper of general
circul~.ation in the County of Butte, State of California .
