HomeMy WebLinkAbout15-041 lX 1 W tl J{ t w m 5 j ;Or�rl �u'lltT�(,u'.P,�4 iiVr'fV ,� bi. :.�. . . 1 �r,b'{, .m� Y',..{ a ,ti h ,.�,,.. ..,r��,;i w�r�(�`al ,,. �.!�,.ni�., .� ..........;�m l' Resolution No. 15-041 Ar A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS CERTIFYIING THE FINAL SUPLE ENTAL ENVIRONMENTAL IMPACT REPORT FORAMENDMENTS TO BUTTE COUNTY CODE CHAPTER 24(ZONING ORDINANCE) PERTAINING TO SPECIAL EVENT FACILITIES WHEREAS,the Butte County General Plan 2030 (GP 2030) Update process was initiated by action of the Board of Supervisors, including the adoption of Resolution 06-055 on May 23, 2006, which created the Butte County General Plan Citizens Advisory Committee and set in motion a process of holding public workshops and meetings regarding the County's GP 2030 Update and the Zoning Ordinance Update; and WHEREAS, the Board of Supervisors Certified a Final Environmental Impact Report (FEIR) and adopted General Plan 2030 on October 26, 2010(State Clearinghouse dumber 2005092062); and WHEREAS, a Final Supplemental Environmental Impact Report (FSEIR) (State Clearinghouse Number 2012022059) was certified by the Board of Supervisors on November 6, 2012; and, WHEREAS, a Final Supplemental Environmental Impact Report (SCH #2014072052) (SEIR) for amendments to the Zoning Ordinance pertaining to special events facilities has been prepared that supplements the General Plan 2030 2010 FEIR and 2012 FSEIR; and, WHEREAS, the Final Supplemental EIR describes the potential environmental impacts of the Special Events Facilities Ordinance as compared to those of the adopted General Plan 2030 and Zoning Ordinance, as evaluated in the 2010 EIR and 2012 Supplemental EIR. WHEREAS, in accordance with Section 15163(b) of the CEQA Guidelines, this Draft Supplemental EIR contains the information necessary to make the previous EIRs, which are the 2010 EIR and 2012 SEIR, adequate for the project as revised. WHEREAS, the Notice of Preparation for the Special Events Facilities Ordinance Draft Supplemental EIR was published on July 14, 2014. WHEREAS, the Draft Supplemental EIR was circulated for a 45-day public review period from October 27, 2014 through December 11, 2014; and, WHEREAS, a Final Supplemental EIR was prepared in accordance with CEQA, which included responses to all comments received on the Supplemental EIR; and, WHEREAS, the Planning Commission held a duly noticed public hearing for the purposes of accepting public comment on the Draft Supplemental EIR in accordance with the Butte County Environmental Review Guidelines, on November 13, 2014; and, WHEREAS, the Planning Commission held a duly noticed public hearing on January 22, 2015 for the purposes of making a recommendation on the certification of the Final SEIR to the Board of Supervisors; and, WHEREAS,the Board of Supervisors held a duly noticed public hearing on February 24, 2015, and continued this hearing until March 24, 2015,for the purposes of reviewing and certifying the Final SEIR; and, WHEREAS,the Board of Supervisors has reviewed and considered in light of public comments and testimony the information in the Final SBR administrative record, staff reports, and all ora} and written testimony for adequacy, completeness and compliance with CEQA, and the State CEQA Guidelines. NOW,THEREFORE, BE IT RESOLVED,that the Board of Supervisors hereby makes the following findings: 1. Notice of the Board of Supervisors hearings on the project's environmental review documents was given as required by law and the actions were conducted in accordance with CEQA, and the State CEQAGuidelines. 2. All individuals, groups and agencies desiring to comment were given adequate opportunity to submit oral and written comments on the environmental review documents.The opportunities for comment meet or exceed the requirements ofCE[1A. 1 All comments submitted during the public review/ and comment period on the Draft SBRwere responded to adequately. 4. The Board ofSupervisors was presented with all ofthe information described inthe recitals and has considered this information in adopting this resolution. 5. The Final SE|R (a) has been completed in compliance with the intent and requirements ofCEOAand the State CEQA Guidelines, (b) reflects the independent judgment and analysis of the County of Butte, which is the lead agency, and (c) has been presented to and reviewed and considered by the Board of Supervisors in its deliberations regarding the recommendation for adoption of the amendments to the Zoning Ordinance pertaining tospecial event facilities. BE IT FURTHER RESOLVED, that the Board of Supervisors hereby certifies the Final GE1Rfor the Special Events Facilities Ordinance.
