HomeMy WebLinkAbout1508ORDINANCE NO. x.508 1 2 _. ~ 3 4 5 8 7 8 9 10 I1 12 13 14 15 16 17 18 zs 2d 21 22 23 24 25 26 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF' BUTTE, STATE OF CALIFORNIA, A TM-10 (TIMBER MOUNTAIN) DISTRICT, PURSUANT TO ORDINANCE NO. 475, AS AMENDED The Board of Supervisors of the County of Butte, State _ __ of California, under and pursuant to Ordinance No. 475, as amended DO ORDAIN, as follows: SECTION 1. The hereinafter described area situated in the County of Butte, State of California, shall~be and it is here- by zoned as a TM-14 (Timber Mountain) District, and such area shall be subject to the restr~.ct+ions and restricted uses and re- gulations hereinafter specified and rpovided. Said area located in the Magalia-DeSabla area, more particularly described as follows: Lots 1, _2., 3, anr~ 4 of that parcel map recorded in Book 42 on Page 65 of the Butte~County Recorder. Lots 1, 2, 3, and 4 of th~it parcel:~.map recorded in Book 42 on Page 78 of the Butte County.Recorder. That. portion of Sectivn_2S, T2.3N,.R3E~., MDB&M bounded on the north, east and west by Lot.l and; on the south, eas and west .by Lot 3, both of parcel n~ap~recorded in Sook 42 on Page 78 of the Butte County Recorder. Containing 79.68 acres, more or less-~ SECTION 2. REGULATIONS FOR A TNi-M1~'°`_~7'ISTRTCT: The following regulations shall apply in a TM-lO~~Distriet°: 2.1 a. b. c. USES PERMITTED: Single-family dwellings, including mobile hofrtes. Management, raising, harvesting and removal of tree , shrubs, seedlings, flowers, nerbs.an.d all food crop for human or animal consumption,,. Keeping, raising-and pasturing bf cattle, horses, sheep, goats, hogs or other livestock, provided that no~more than two (2} such animals be kept per acre • on parcels of less than five (5) acres and no mare than four (4) such animals be kept on parcels of five (5) acres or more. e. Prospecting, claiming, drilling, mining,. excavating and dxedging of mineral, hydrocarbon and geothermal resources, except as limited in 2.2. f. Protection of land and forests from fire, erasion, floods, slides, quakes, insects, diseases and pollu- tion, including arboretums and natural wilderness, experimental and stuiiy areas. g. Display and sale of products of agricultural uses and home arts and crafts produced on the premises. h. Accessory uses, improvements and structures Gusto-- many and pertinent to permitted uses, except as limited in 2.2, including guest houses, barns, sheds, shops, garages and storage areas. 2.2 USES PERMITTED SUBJECT TO FIRST SECURING A USE PERMIT IN EACH CASE: a. Commercial wood processing plants. c. Commercial kennels and animal hospitals. d. Coranercial livestock feed yards . e, Animal product processing plants. f. Mining, quarrying and excavating activities which might be ob3ectionable by reason of noise, odor, smoke, dust, bright light, vibration, stream pollu- tion or handling of explosives or dangerous material g. Commercial boat ramps, docks and landing facilities. h. Aircraft landing facilities. i. Disposal areas and sewage treatment facilities. j. Public and quasi-public uses including schools, parks, playgrounds, recreational facilities, utility system structures, meeting halls, hospitals,. libra-'~, i ries, museums, government offices and similar uses. k. Pr~.vate or commercial outdoor recreation facilities on sites of not less than five (5) acres, including country clubs, gbif courses, riding .academies and stab~.es, hunting and fishing, camps and other clubs, and gun clubs and ranges. 2.3 LOT AREA: Minimum required area~pf a tat per dwelling unit shall not be less than ten {14) -acres for TI+~:~1Q . -3 -- 1 2 _3 4 5 6 7 8 9 10 I1 12 13 14 15' 16 i 17 18 is 2a 2I 22 23 24 25 28 2.4 LOT WIDTH REQUTREn: Minimum required lot width, shah. not be less than -sixty-five (65) ft. 2 .5 FRONT YARD REQUIRED Minimum required front building setback shall be no~ less than fifty (50) ft. from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum required front building setback shall be not less than fifty-five {55) ft. from the centerline of the road. 2.6 SIDE YARD REQUIRED: Minimum required side building setback shah. be not less than fifteen {15} ft. for "TM-10". 2 .7 REAR YARD REQUIRED Minimum required rear building setback shall be not less than twenty ~ (20) ft. for- TM-10 . SECTION 3. All uses of land not specifically authorize and permitted under Section 2 are prohibited within the district. SECTION 4. In compliance. with the provisions of the .Zoning Enabling ordinance the same is hereby amended by adding this ordinance in full. SECTION 5. This ordinance shall be and it is hereby ,declared to be in ,full force from and. after thirty (3{~) days after the date of its passage and before the expiration of fifteen {1~) days after its passage this ordinance shall be published once with the names of the members_of the. Board voting for and against it in the Paradise Post , a newspaper published in the County of Butte, State of California.
