NOW,THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the County of Butte, State of California: 1. Construction and operation of the Revised Supplemental Jail Facility would not have a significant effect on the environment at its new location north of the existing jail, with implementation of mitigation measures identified in the 2014 IS/MND, with the exception of Mitigation Measure #6 which was found to be not applicable to the new project site. 2. The Revised Supplemental Jail Facility entails a relatively minor construction project that, when operating, would accommodate about a ten percent (10%) increase to the current average County Jail population and staff; 3. Substantial changes with respect to the circumstances under which the project is undertaken have not occurred since the 2014 IS/MND was adopted on July 29, 2014; 4. No new information of substantial importance has been identified, which was not known and could not have been known with the exercise of reasonable diligence at the time of MND adoption; and 5. Construction and operation of the Revised Supplemental Jail Facility at its new location north of the existing Jail would not result in any new or substantially more severe significant effects than would occur with the Original Project and no additional mitigation measures are required. An Addendum to the 2014 IS/MND is the appropriate document and recirculation of the adopted IS/MND is not necessary as the project does not have the potential to result in: a. Any of the conditions described in Section 15162 and 15164 of the CEQA Guidelines that would require the preparation of a subsequent Environmental Impact Report or negative declaration (Section F. of the Addendum); b. An impact upon agricultural resources, or mineral resources; c. A significant impact upon biological resources, geology and soils (geologic hazards), land use, population and housing, public services, recreation, transportation/traffic, and utilities and services; and d. A significant impact with existing mitigation incorporated for aesthetics/visual resources (nighttime glare), air quality (fugitive dust and diesel emissions), cultural resources (subsurface resources), greenhouse gas emissions (diesel emissions), hydrology and water quality (stormwater runoff and adequate drainage), or noise (construction noise). BE IT FURTHER RESOLVED that the Butte County Board of Supervisors hereby affirms the following mitigation measures for the Supplemental Jail Facility, as revised: Mitigation Measure#1-Aesthetics (Minimize Off-Site Glare from Exterior Lighting); Mitigation Measure#2-Air Quality (Ensure Adequate Dust Control); Mitigation Measure#3 -Air Quality (Minimize Combustion Emissions from Heavy-Duty Construction Equipment) Mitigation Measure#4—Cultural Resources (Protection of Cultural Resources Found During Work); Mitigation Measure#5—Hydrology/Water Quality (Prepare Low Impact Development Plan to Manage Post-Construction Stormwater Runoff); Mitigation Measure#7—Noise (Limit Work to Daytime Hours and Provide Best Available Noise Suppression). BE IT FURTHER RESOLVED that the Butte County Board of Supervisors approves filing of an application for funding to construct the proposed Supplemental Jail Facility.
