AN ORDINANCE.ZONING A PORTION OF. THE. COUNTY OF
BUTTE, STATE OF CALIFORNIA, AN "TM-1" (TIMBER-
MOUNTAIN) DISTRICT
1 The Board of Supervisors of the County of Butte, State
- 2 of California, under and pursuant to Ordinance No. 4?5, . of said

3 County, being the Zoning Enabling Ordinance of said County, as
¢ amended, DO ORDIAN, as follows:
S SECTION 1. The hereinafter described area, situated in
6 the County of Butte, State of California, shall be and it is
7 hereby zoned as an "TM-1" {Timber-Mountain} District, and such
~ area shall be subject to the restrictions and restricted uses
~ and regulations hereinafter specified and provided. Said area
10 located at Lake Madrone near Berry Creek,. California,. being
11 a portion of Sec Z7, TZ1N, RSE, MDB&M, particularly described ~'~
12 as:
13 "Feather River Forest Homes"
14 "Cascade Addition" per map recorded in map book 9
on Page 33 A;
15 "Spring Valley Addition" per snap recorded in map
16 book 24 on Pages 3, 4, & 5;
1~ "Lakeview Addition" per map recorded in map book
A vn Pages Z1 and 21 A;
18 "Feather River Forest Homes, Unit #1" per map recorded
19 in map book 8 on Pages Z9 A and 30 A.
20 "Feather River Forest Homes, Unit #2" per map recorded
in Map book 35 on Pages 1, 2, & 3; and

All that portion of said Sec 27; adjacent to "Feather

Being a portion of Sec 27, T21N, R5E, MDB&M, and des-
cribed as:

Orovilie-Quincy Rd. right-of--way, west of Lake Madrone

5ECTION 2. Regulations for a "TM-1" District. The
following regulations shall apply in a "TM-1" District:
2.1. USES PERMITTED
a. Single--family dwellings, including mobile homes.
b. Management, raising, harvesting and removal of tra
shrubs, seedlings, flowers, herbs and all food crop
for human or animal consumption.

c. Keeping and raising small animals far domestic use,
including dogs, cats-and household pets, poultry
and other birds, bees, fish and frogs.
d. Keeping, raising and:..pasturing of_:cattle, horses,
sheep, goats, hogs, or other livestock, provided I'~

that no mare than two (2) such animals be kept per
acre on parcels, of less than five (5) acres and no
more than. four (4) such animals be kept per acrd on
parcels of five (5) acres or more.
e. Prospecting, claiming, drilling, min~_ng, excavating
and dredging of mineral, hydrocarbon and geothermal
resources, except as limited in 2.2.
f. Protection of land and forests from-fire, erosion,
floods, slides, quakes, insects, diseases and
pollution., including arboretums and natural wild-
erness, experimental and study areas.
g. Display and sale of products of agricultural uses
and home arts and crafts prod;aced on the premises.
h. Accessary uses, improvements and structures
customary and pertinent to permitted uses, except
as limited in 2.2, including guest houses, barns,
sheds, shops, garages and storage areas.
2.2 USES. PERMITTED SUBJECT TQ E'IRST SECURING A. USE
PERMIT IN EACH CASE:

greater densities.
b. Commercial wood processing plants.
c. Comznereial kennels and animal hospitals.
d. Commercial livestock feed yards.
e. Animal products processing plants.
f. Mining, quarrying and excavating activities which
might be objectionable by reason of noise, odor,
smoke, dust, bright. light, vibration, stream pollu-

g. Commercial boat ramps, docks and landing facilities.
h . Aircraft landing facilities .
i. Disposal areas and sewage treatment facilities.
j. Public and quase-public uses including schools,
parks., playgrounds, recrea'tinnal facilities, utility
system structures, meeting halls, hospitals, libra-
ries, museums, government offices and similar uses.
k. Private or commercial outdoor recreation..facilitiss
on sites of not less than five (S) acres, including
country- clubs, golf courses, driving ranges, racing
tracks and courses, riding academies and stables,
hunting and fishing-camps and clubs, ancl.gun clubs
and ranges.

2.4 LOT WIDTH REQUIRED:

2.5 FRONT YARD REQUIRED:
Minimum required front building setback shall be
not less than fifty { 50 ) ft . from the centerline
of the road, except where the road is classified
by the County as a Federal Secondary Raad, the

not less than fifty-five (55) ft. from the center-
line .
2.6 SIDE YARD RE,QUIRED:-
Minimum required side building shall be not less
than f ive { 5 ) ft .
2.7 REAR YARD REQUIRED:
Minimum required rear building setback sha11 be not
less than five (5) ft.
SECTION 3. All uses of land within the district not
specifically authorized and permitted in Section 2 are prohibited
SECTION 4. In compliance with the provisions of the
Zoning Enabling Ordinance, the same is hereby amended by adding
this Ordinance i.n full.
SECTION 5. The penalties for the violation of the
Zoning hereby imposed within the district shall be as provided

in the Zoning Enabling Ordinance. In compliance with the provi-
sions of the Zoning Enabling Ordinance, this Ordinance shall from

tha Zoning Enabling Ordinance.
SECTION 6. This ordinance shall be and it is he rsby
declared to be in full force and effect from and after thirty
(30) days after the date of its passage, and before the expira-
tion of fifteen (1S) days after its passage, this Ordinance shall
be published once with tha names of the memebers of the Board of
Supervisors voting for and against the same in the Oroville
Mercury , a newspaper published in the County of Butte,
State of California.

County of Butte, State of California, this 15th. day of
October 1974, by the fol~.owing vote:
