RESOLLIT1N FO" EMPLOYE" PAID MEI IRE' CONTRI;UT1ONS(E"MC)
FOR SUPE'10" COURT OF CALIFORNI A EMPLOYEES
WHEREAS, prior to 2001,the Butte County Superior Court employees were employees of Butte County; and
WHEREAS, in 2001, the State passed the Trial Court Employment Protection and Governance Act, which
removed the Court employees from County Service and established the Court as the employer; and
WHEREAS,the Court is responsible for negotiating with the Court employees on mandatory subjects of
bargaining, and
WHEREAS,the Court employees remain under Butte County's contract with CaIPERS for retirement; and
WHEREAS, pursuant to CaIPERS regulations, CaIPERS requires that the Governing Board that holds the contract
with CaIPERS(Butte County) must adopt and transmit a resolution related to an employer's change in the Employer Paid
Membership Contribution (EPMC); and
WHEREAS, in accordance with Board of Judges, Superior Court of California resolution No. 2015004 (See
Attachment A), the governing body of the Superior Court of California, County of Butte has identified the following
conditions for the purpose of its election to pay EPMC pursuant to Government Code Section 20691:

THEREFORE BE IT RESOLVED that the Resolution supersedes and replaces resolution no. 13-022 of the Butte
County Board of Supervisors pertaining to EPMC paid for Superior Court employees; and
1:E IT FURTHER RESOLVED,that this resolution is adopted on October 13, 2015 and effective October 1, 2015;
PASSED AND ADOPTED by the Board of Supervisors, of the County of Butte, State of California, at a regular
meeting of said Board, held on the 13th day of October, 2015, by the following vote:

WHEREAS,the governing body of the Superior Court of California, County of
Butte (the Court) has the authority to implement Government Code section 20636 (c)

part of an employee's member contribution to Ca1PERS and has to date paid 3.5

NOW,THEREFORE,BE IT RESOLVED,that this resolution is adopted by the
Executive Committee of the Board of Judges on September 30, 2015,and is effective
October 1, 2015.
The Presiding Judge and Court Executive Officer of the Butte County
Superior Court hereby certify that the above foregoing resolution was duly and
regularly adopted by said Butte County Superior Court on September 30, 2015
