COUNTY WHEREAS, the Sustainable Groundwater Management Act of 2014 went into effect on January 1, 2015; and WHEREAS, the Sustainable Groundwater Management Act of 2014 enables the State Water Resources Control 4 oard to intervene in groundwater basins unless a local public agency or combination of local public agencies form a Groundwater Sustainability Agency or Agencies (GSA) by June 30, 2017 (Water Code §10735); and WHEREAS, retaining local jurisdiction over water management and land use is essential to sustainably manage groundwater and to the vitality of Butte Cou ty's economy, communities and environment, and W 'EREAS, any local public agency that has water supply, water management or land use responsibilities within a subbasin may elect to be a Groundwater Sustainability Agency (Water Code §10721 and §10723(a)); and WHE ' i AS, counties are presumed to be the Groundwater Sustainability Agency for areas within a basin that is not within the management area of another Groundwater Sustainability Agency (Water Code §10724); and WHE ' AS, Butte County is eligible and presumed to be a Groundwater Sustainability Agency for the portions of the Vina, West utte, East {tate and North Yuba subbasins in Butte County; and WHEI!'EAS, other local public agencies in Butte County have elected to be a GSA a d have notified the Department of Water Resources of its intent to undertake sustainable groundwater management; and WIIE111'EAS, within 90-days of an entity giving notice to the Department of Water Resources of the intent to form, or having formed, a GSA, that entity shall be presumed to be the exclusive GSA for that area unless another entity provides notice to the Department of Water Resources of their intent to form, or notice that the entity formed, a GSA (Water Code §10723,8); and WHEREAS, establishing Butte County as a Groundwater Sustainability Agency will enable the County to work with other GSAs in the preparation and implementation of an effective and mutually beneficial Groundwater Sustainability Plan(s) for the sustainable groundwater management in Butte County: and WHEREAS, Butte County intends to work cooperatively with other local public agencies to manage the aforementioned groundwater basins in a sustainable fashion; and WHEREAS, adoption of this Resolution does not constitute a"Project" under the California Environmental Quality Act (CEQA) pursuant to Sections 15378(a) and (b) of Title 14 of the California Code of regulations because this Resolution does not result in a direct or indirect physical change in the environment; and VVHEI'EAS, the Board of Supervisors held a public hearing on this date and after publication of notice pursuant to Government Code section 6066 to consider the election to become a GSA. NOW, THEREFORE, I E IT RESOLVED, that the Board of Supervisors of the County of Butte hereby elects to become a Groundwater Sustainability Agency for the portions of the County that overlie the Vina (5-21.57), West I utte (5-21.58), East Butte (5-21.59) .nd North Yuba (5-21.60) subbasins as depicted by the Department of Water Resources Bulletin 118 (Update 2003). BE IT FU 11 ER RESOLVE m , that within thirty (30) days of this date, the I utte County Department of Water and Resource Conservation is directed to provide notice of this election and intent to undertake sustainable groundwater management for the aforementioned subbasins to the Department of Water Resources in a manner required by law. I E IT FURT1 ER RESOLVE 111 that the Butte County Department of Water and Resource Conservation shall continue discussions with other local public agencies in order to begin the process of developing a groundwater sustainability plan for the aforementioned subbasins that underlie g utte County.
