HomeMy WebLinkAbout15-164 A ;c,foolillimi,,r, ,frifl;41 y" 41'0 0 oiklil 7/ /00,46ti771,4 '(° 4410406 elittri, /',011PriP11,14;01/101,1/),,lerti,v/?,(143,, /p,,"'„0117144,,,,r,,,litr,"'1,7„Y,,444,jtool„141:11,4clywriiiitilif /it'll 401/17/A i F(00,0' AO 4 Oil*' ' #0141;14111P 14011''11' Resolution No, 15-164 1.104,i'lliI 4'0 j' 1 RESOLUTIO1 FOR EXEMPTION TO THE 180-DAY WAIT PERIOD TO HIRE CALPERS RETIREE PER GOVERNMENT CODE SECTIO 1 IS 752236 A D 21224 WHEREAS, in compliance with Government Code section 7522.56, the County of Butte must provide CaIPERS this certification resolution when hiring a retiree before 180 days has passed since his or her retirement date; and WHEREAS, Daniel Young (Employee#32585) retired from the Butte County Sheriff's Office on November 6th, 2015,from the position of Correctional Sergeant; and WHEREAS, Government Code section 7522.56 requires that post-retirement employment commence no earlier than 180 days after the retirement date, which is May 4th, 2016, without this certification resolution; and WHEREAS, Government Code section 7522,56 provides that this exception to the 180 day wait period shall not apply if the retiree accepts any retirement-related incentive; and WHEREAS,the County of Butte, the Butte County Sheriff's Office and Daniel Young certify that Daniel Young has not and will not receive a Golden Handshake or any other retirement-related incentive; and WHEREAS,the County of Butte hereby appoints Daniel Young as an extra help retired annuitant to perform duties as a non-sworn Investigative Assistant for the Butte County Sheriff's Office permitted under Government Code section 21224, effective November 11th, 2015; and WHEREAS, the entire employment agreement appointment document between Daniel Young and the Butte County Sheriff's Office has been reviewed by this body and is attached herein; and WHEREAS, no matters, issues, terms or conditions related to this employment and appointment have been or will be placed on a consent calendar; and WHEREAS, the employment shall be limited to 960 hours per fiscal year; and WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties, divided by 171333 to equal the hourly rate; and WHEREAS,the minimum monthly base salary for this position is$2,750.14 and the hourly equivalent is$15.87, and the maximum monthly base salary for this position is$3,685.47 and the hourly equivalent is $21.26; and WHEREAS, the hourly rate to be paid to Daniel Young will be $21.26; and WHEREAS, Daniel Young has not and will not receive any other benefit, incentive, compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate; NOW, THEREFORE, BE VT RESOLVED, that the Butte County Board of Supervisors hereby certifies the nature of the appointment of Daniel Young as described herein and that this appointment is necessary to address the need to fill fifteen deputy sheriff vacancies by assisting in the background process.
