A RESOLUTION OF THE BOARD OF SUPERVISORS, COUNTY OF BUTTE, STATE OF CALIFCIR IA
MAKING FINDINGS AND DENYING THE APPEAL OF THE PLANNING COMMISSION'S REMOVAL OF A RECOMMENDED
CONDITION OF APPROVAL IN THE APPROVAL OF MINOR USE PERMIT MUP1S-0003
WHEREAS, the Board of Supervisors has considered an appeal of a Planning Commission decision not to adopt a
staff recommended condition of approval in its approval of Minor Use Permit MUP 15-0003 for Sacramento Valley
Limited Partnership., requiring the applicant to deed to Butte County in fee simple 30 feet of right-of-way from each side
of the physical centerline (60 feet total width) of Humboldt Road along the entire property frontage, in accordance with
Chapter 24, Article 37; Appeals and Calls for Review, of the Butte County Code on Assessor's Parcel Numbers 060-080-
010; and
WHEREAS, the Board of Supervisors has considered information provided by the applicant and the Butte County
Department of Public Works, and
HEREAS, a duly noticed public hearing was held by the Planning Commission on October 22, 2015; and
WHEREAS, the Board of Supervisors has considered public comments, reports from the Planning Division, and
the appeal letter on record:
NOW,,THE EF RE, BE IT RESOLVED that the Board of Supervisors:
I. Makes the following findings regarding the appeal of the Planning Commission's decision not to adopt a staff
recommended condition of approval requiring the dedication of right-of-way:
A. The requirements of Butte County Code section 2642.1 are not applicable to the proposed
Telecommunication Facility;
B. The proposed project does not create a health, welfare or safety issue to the general public, including but
not limited to those people residing within said areas as those using roads in said areas..
II. Denies the appeal by Butte County Department of Publiiic. Works and upholds the Planning Commission's
approval of Minor Use Permit(MUP1S-0003).
PASSED AND ADOPTED by the Butte County Board of Supervisors this 8th day of December, 2015 by the following vote:
AYES: Supervisors Connelly, Wahl, Kirk, and Lambert
NOES: Chair Teeter
