AN .INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY 1 OF BUTTE AN "AR-MH" (AGRICULTURAL-RESIDENTIAL-MOBILE HOME} DISTRICT, PURSUANT TO ORDINANCE NO. 475, AS '~: AMENDED 3 The Board of Supervisors of the County of Butte, State 4 of California, under and pursuant to Ordinance No. 475, as amended, 5 and declaring an emergency, DO ORDAIN as follows; 8 SECTION ~.. The hereinafter described area situated in _ _ 7 the County of Butte,- State of California, shall be and it is here- 8 by zoned as an "AR-MH" (Agricultural-Residential- Mobile Home} 9 District, for a period of x.20 days, and such area shah. l0 be subject to the restrictions and restricted uses and regulations ~-l hereinafter specified and provided. Said area so zoned being 12 located in the unincorporated area of Butte County, being located 13 north of Oroville, and more particularly described as follows: Z4, All that real property situated in the County of I5 Butte, State of California, described as follows: All that portion of Rancho Esquon-line southerly l6 of existing Highway 99 E more particularly des- l7 cribed as follows: Commencing at an Engineers' Station C2 74+00 thence ~'$ S 480 24' 48" W, 80 ft. to the Highway right-of~-way x9 line as the true point of beginning, thence S 480 24' 4fl" W~ ~aQ ft, thence N 410 35' 20" W, 600 ft., 24 thence N 480 24' 4a" E, 6{3Q ft. thence S 440 45' 43" E, along the Highway right-of-way to the true -~-~~::~:'_. 2I point of beginning. 22 Said area containing $.3 acres, more or less. 23 i SECTION 2. REGULATIONS FOR AN "AR-MH" DISTRICT; .24 The fallowing regulations shall apply in an "AR-MH" :.District: ;fig 2.1 (USES PERMITTED -1- /~~7 1 a. Single-family dwellings. 2 b, Mobile Homes - to house one family, when such mobile 3 home is the only housing facility located on the 4 premises, provided the following conditions are 5 conformed to: B 1) The gross area of the mobile home shall not be 7 less than 500 sq. ft. 8 2} All sanitary facilities shall conform to State 9 Statutes and regulations and to local require- 10 ments of the Butte County Health Department. 11 3j All electrical installations shall conform to 12 State Statutes and regulations as administered i3 by the Building Division of the Butte County 14 Public Works Department. 15 c. Accessory buildings pertinent to the permitted uses. 16 d. Agricultural uses. 17 e. Livestock, subject to requirements as follows: Z8 1) Minimum lot area to be devoted to residential Z9 use shall be not less than eight thousand, one 20 hundred twenty-five ( $,125 } sq , ft . 21 2 ) Exclusive of the area devoted to the residential. 22 use, the following lot or parcel areas shall be 23 required for each animal raised or kept on the 24 ~ premises :. !, ~ a) For each horse or head of cattle over one ~~ (l; year of age -- eight thousand one hundred -2- ~' twenty--five (8,125) sq. ft. 2 b) For each head of swine over ten (].0} weeks 3 of age - eight thousand, one hundred twenty- 4 five (8,125} sq. ft. 5 c} For each head of sheep or goats - two 6 thousand (2,000} sq. ft. 7 2 .2 TEE FOLLOWING USES SUBJECT TO .SECURING A USE PERMIT 8 IN EACH CASE: 9 a. Duplex dwellings and multiple-family dwellings. 10 b. Golf courses, country clubs, if permitted, would 11 permit accessory uses such as driving range, ~rro 12 shop, cocktail bar, restaurant. 13 c. Public and quasi-public uses includ~.ng churches, 14 firehouses, hospitals, parks and playgrounds, 15 schools, and public utility buildings. 16 d. Commercial poultry farming and livestock farthing, 17 e. veterinary clinics, outpatient. 18 f, Nurseries and plant gardens. 19 2.3 LOT AREA REQUIRED: 20 Minimum re wired area of lot q per dwelling unit shall 21 be not less than eight thousand, one hundred twenty- 22 five (8,125) sq. ft. 23 2.4 L4T WIDTH REQUIRED: 24 Minimum lot width shall be not less than sixty-five 2b (55} ft. 2B 2.5 FRONT YARD REQUIRED: -~- i Minimum front yard shall be fifty (50) ft. from the 2 centerline of the road, except where the road is 3: classified by the County as a Federal Aid Secondary 4 Road, the minimum building setback requirement shall 6. be fifty-five (55) ft. from the centerline of the 6 road. ? 2.6 SIDE YARD ~2EQUIRED:. . 8 Minimum side yard shall not be less than five ('5) ft 9 SECTION 3. All uses of land within the District not 10 specifically authorized and permitted under Section 2 are prohi- ~.1 bited . 12 SECTION 4. Penalties for any violation of the zoning 13 hereby imposed within the District shall be as provided in the 14 Zoning Ordinance. In compliance with the provisions of the Zoning 15 Enabling Ordinance, this Ordinance shall from and after its effec- 18 five date become a supplement to and part of the Zoning Enabling 17 Ordinance . 1$ 5ECTION 5. This urgency ordinance shall take effect i9 immediately upon its passage, and before the expiration of fifteen 20 (15) days after its passage shall be published once with the names 21 of all members for and against the same in the 22 a.newspaper in general circulation in•~ 23 the County of Butte, State of California. The facts constituting ~ -the urgency on which this ordinance is based are:. ~ ]..
