ORDINANCE NO. X528
AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE,
STATE OF CALIFORNIA, AN "A-R-S" (AGRICULTURAL-RESIDENTIAL)
DISTRICT, AND.ESTABLISHING REGULATIONS FOR THE USE OF LAND
~ AND THE CONSTRUCTION OF BUTLDSNGS.
2 The Board of Supervisors of the County of Butte, State
3 of California, under-and pursuant to Ordinance No. 475, as
9" amended, DOES ORDAIN as follows:
b SECTION 1. The hereinafter described area situated in
6 the County of Butte, State of California, shall be and it is hereby
7 zoned as an "A-R-S" (Agricultural-Residential) District and such ;
$ area shall be subject to the restrictions and restricted uses and
9 regulations hereinafter specified and provided. Said area so
10! zoned being located in the unincorporated area of Butte County
lI'-near Oroville, California, more particularly described as follows:
12' All of Lots 132 through 143 of "Oroville Wyandotte Fruit
Lands, Unit No. 4" per map in Book 11 on Pages 27, 28,
I3 29, 30 and 31 of the Butte County Recorder, and also:
14 A portion of Section 24, Township 19 North, Range 4 East,
MDB&M, more particularly described as follows:

BEGINNING at the Northeast corner of Lot 13S of
16 "Oroville Wyandotte Fruit Lands, Unit No. 4", here-
tofore filed in Book 11 of Maps, at pages 28 through
17 33, records of Butte County, Californ~.a; thence
South 89° 20' 43" West along the Northerly line of
18 said Lot l35 of "Oroville Wyandotte Fruit Lands,
Unit No. 4" a distance of 810 feet, more or less, to
19 the Southeast corner of that certain parcel of land
described in Deed from Hubert T~. Townshend et al to
20 Olaf O. Larson, et u~c, dated November 30, 196.6, and
recorded December 15, 1966, in Book 1453, of Official
2~ Records, at page 470, records of Butte County; thence
Northerly along the Easterly line of said Larson,
22 et ux, parcel, the following courses and distances:
North 080 Sl' 54" East, 420.24 feet and North 110
23 16' 00'" East, 648.24 feet to the Northeast corner of
24 said Larson, et ux, parcel; thence North 89° 20' 43"
East and parallel with the Northerly line of said
Lot 135 of "Oroville Wyandotte Fruit Lands, Unit No.
4", a distance of 900 feet; thence in a direct line,

2 SECTION 2. REGULATIONS FOR AN "A-R-5" DISTRICT:
3 The following regulations shall apply in an "A-R-S"
4 District:
~ 2.1 USES PERMITTED
6 a. Single-family dwellings, not including .tents o
"1 trailers.
$ b. Accessory buildings pertinent to the permitted uses.
9 c. Agricultural uses.
10 d. Livestock, subject to requirements as follows:
I1 1. Minim~un lot area to be devoted to residential
12 use shall not be less than five (5) acres.

3~ 2. The following lot or parcel areas shall be requir
l5 for each animal raised or kept on the premises.
18 a. For each horse or head of cattle over fine {1)
17 year of age -- eight thousand one hundred
~'$ twenty-five (8,125) square feet.
19 b. Far each head of swine over ten (l0) weeks of
2U age -- eight thousand one hundred twenty-~
21 five (8,125) square feet.
22 c. For each head of sheep or goats -- two

2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT

IN EACH CASE:
28 a. Duplex dwellings and multiple-family dwellings.

1 b. Golf courses, country clubs, if permitted, would
2 permit accessory uses such as driving range, pro
3 shop, cocktail bar, restaurant.
~ c. Public and quasi-public uses including churches,
5 firehouses, hospitals, parks and playgrounds, schools,
~ and public utility buildings..
7 d. Commercial poultry farming and livestock farming.
S e. Veterinary clinics, outpatient.
~ f. Nurseries and plant gardens.
I~0 2.3 LOT AREA REQUIRED:
l~ Minimum. required area of a lot per dwelling unit
12 shall be not less than five (5) acres.
13 2.4 LOT WIDTH REQUIRED:
I4 Minimum lot width shall not be less than one hundred ~~
15 thirty (130) feet.
16 2.5 FRONT YARD REQUIRED:
17' Minimum front yard shall be fifty (50) feet from the
].8 centerline of the road, except where the road is
19 classified by the County as a Federal. Aid Secondary
2Q Road, the minimum building setback requirement sha11
2I be fifty-five (55} feet from the centerline of the
2~ road.
2S 2.6 SIDE YARD REQUIRED:
24 Minimum side yard shall not be less than ten (10)
23 feet.
~$ SECT ION 3. All uses of land within the district not

specifically authorized and permitted in Section 2 are prohibited.
SECTION 4. In compliance with the provisions of the
Zoning Enabling Ordinance the same is hereby amended by adding
this ordinance in full.
SECTION 5. The penalties for the violation of the zoning
hereby imposed within the district shall be aspprovided in the
Zoning Enabling Ordinance, In compliance with the provisions of
the Zoning Enabling Ordinance this ordinance shall be from and
after its effective date become a supplement to and part of the
Zoning Enabling Ordinance.
SECTION 6, This ordinance shall be and it is hereby declar
'to be in full force from and after thirty X30) days of ter the date
of its passage, and before the expiration of fifteen X15) days
.after its passage .this ordinance shall be published once with the
names of the members of the Board voting for and against it in the
