ORDINANCE NO. I530
AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY
1 OF $UTTE AN "C-C" (COMMUNITY COMMERCIAL} DISTRICT,
PURSUANT TO ORDINANCE NO. X75, AS AMENDED
~ The Board of Supervisors of the County of Butte, State of

California, under and pursuant to Ordinance No. x€75, as amended, anc
4, dec3:aring an emergency, DO ORDAIN as follows
6 SECTION 1. The hereinafter described area situated in
6 the Ct~tii'~ty of Butte, State of California, shall be and it is here--
by zoned as an "C-C" (Community Commercial)- District, for a period
$ of J.20 days , and such area shall be Sub jeCt to the re-~
~ striations and restricted uses and regulations hereinafter specifiE

and provided. Said area so zoned being located in the unincarpor-

ated area o£ Butte County, being located near Chico, California,
12 and more particularly described as follows:

The southerly 230 ft. of the westerly 13.88 ft, of Lot
14 23 of "Humboldt Sub", per map recorded in Book 2 on Page
198 of the Butte County Recorder.

SECTION 2. REGULATIONS FOR "C-C" DISTRICTS. The

following regulations shall apply in all "C-C" Districts:

2.1 USES PERMITTED:

a. Multiple dwellings and dwelling groups, subject to

the height limit, building site area, average lot

width and yard requirements specified for "R-3"
21
Districts.

b. Hotels, clubs and lodge halls, hospitals, sanitariums

and clinics.

c. Retail. stores and shops of a light commercial charac-

ter and conducted within a building including appli-

ances stores, banks, barber shops, beauty parlors,~~

book stores, cleaner or laundry agents and launderett s.,
dress shops, drug stores, food stores, furniture stor s
millinery shops, professtional offices, restaurants,
refreshment stands, service stations, shoe shops,
storage garages, studios and tailor shops, public
utility commercial offices, and other uses which are
of similar character to those enumerated and which
will not be detrimental or obnoxious to the neighbor-
hood in which they are to be located.
d. The following uses subject to securing a use permit
case:
1. All uses perm~,tted in "R-1" and "R-2" Districts.
2. Mobile Home Parks
3. Public and quasi-public uses.
~. Animal hospitals, auto sales, dancing academies
or .halls, .openair .retail .stores, theaters, pet
..... shops, .wholesale .stores .or .storage, undertaking
establishments,-used car. sales, used or second
hand Qoods, and other uses which are of similar
character.
2.2 BUILDING H3EGHT LIMIT: Forty-five (45} feet.
2.3 MINIMUM LOT WxDTH REQUIRED: Twenty-five (25} feet.
2.4 FRONT YARD REQUIRED: None, except where frontage in
a block is partially in an "R" District, in which
case the front yazd shall be one-half that required
in such "R" District.

2.5 SIDE YARD REQUIRED: None, except where the side of a
lot abuts upon the side of a lot in an "R" District,
in which case the abutting side yard shall be not
less than five (5} feet, and except where the side
yard on the street side of a corner lot abuts on an
"R" District, in which case the side yard an the
street-side shall be one-half the corresponding
front yard required in such "R" Districts.
2 , 6 REAR YARD REQUIRED: Twelve (l2} feet, or Live (5 )
feet adjacent to an alley.
2 .7 OFF~STREET= PAttK"ING: Off-Street parking area shall be
approved in advance and as required by the Planning
Commission.

not exceed three (3} feet in height in front yards,

nor six (6} feet in height in any required rear,or
side yards. In the case of corner-lots, fences,
shrubs, screen plantings or similar obstructions shat
not exceed three {3} feet in height within the sight
distance area.
SECTION 3. All uses of land within the District not

specifically authorized and permitted under section 2 are prohi-
bited.
SECTION 4. Penalties for any violation of the zoning
hereby imposed within the District shall be as provided in the
Zoning Ordinance . In compliance: with the provisions of the Zoning

Enabling ordinance, this Ordinance shal]. from and after its effec-
tive date become a supplement to and part of the Zoning Ena3al~.ng
ordinance.
SECTION 5. This urgency ordinance shall take effect
immediately upon its passage, and before the expiration of fifteen
(15) days after its passage shall be published once with the names
of all members for and against the same in the Chico
Enter rise , a newspaper in general circulat~.on in the County
of Butte, State of California. The facts constituting the urgency
on which this ordinance is based are: -
l. To bring the area into consistency with proposed
land use pending further rezoning hearings.
PASSED AND ADOPTED by the Board of Supervisors of the ~
County of Butte, State of California, on the 19th day of
' November , 19 74 , by the following vote
