The Board of Supervisors of the County of Butte do ordain as follows: Section 26-1 of the Butte County Code is amended to read as follows: Section 26-I. Building Code - Adopted by reference. In order to provide minimum standards for the proper regulation of building construction, the Uniform Building Cade, 1973 Edition, with appendices thereto, prepared and published by the International Conference of Building Officials,is hereby adopted, incorporated, and made a part of this chapter by reference without further publica- tion as though set forth at length herein and is hereby declared tq be the building code for the County and shall apply to and govern all building construction in the unincorporated areas of the County except as hereinafter provided. Section 26-3 of the Butte County Code is amended to read as follows: Section 26-3. Same - Amendments, additions and deletions. The Uniform Building Code as adopted by Section 26-1 is amended as follows: Section 204 of the Uniform Building Code is hereby deleted. The local appeals board of the County which was established by Resolution No. 64-3 by the County Board of Supervisors shall hear any and all appeals regarding the application and enforcement of this chapter. Section 30i(a) of the Uniform Building Code is hereby amended by the addition of the following paragraphs: "No permits shall be required for any agricultural building. Agricultural buildings are defined as follows: 'Agricultural building is a building located on agricultural property and used to shelter farm implements, hay, grain, poultry, livestock, or other farm produce, in which there is no human habitation, is not used commercially and which is not used by the public."' "No permits shall be required for detached structures which have a total net area, including additions, of not more than 1 two hundred (200} square feet, which would have an occupancy 2 classification of Type J as defined in the Uniform Building 3 Code, and which would be detached a minimum of six (6) feet ¢ from any building requiring a building permit. This exemption ~' ~ shall apply to tool sheds, wood sheds, and pump houses. This g exemption shall not apply to carports and garages." 7 Section 302(d) of the Uniform Building Code is amended as $ follows: g "Every building permit issued under the provisions of this 10 code shall expire by limitation and become null and void after 11 one (1) year from date of issuance of said permit. If building 12 is under construction, before work can continue, a new permit lg shall be first obtained and the fee therefor shall be one-half 14 (1/2) the amount required for the original permit; provided, i5 no changes have been made in the original plans." 16 Section 303(a) of said Uniform Building Code is hereby amended 17 as follows: lg Section 303(a) Building Permit Fees. A fee for each building 19 permit shah be paid to the Building Official as set forth in 20 Table No. 3-A. 21 The determination of value or valuation under any of the provi- 22 sions of this Code shall be made by the Building Official. The 23 valuation to be used in computing the permit and plan-check g¢ fees shall be the total value of all construction work for 2g which the permit is issued, as well as all finish work, paint- gg ing, roofing, electrical, plumbing, heating, air conditioning, 27 elevators, fire-extinguishing systems, and any other permanent 2$ work or permanent equipment. Qg Where work for which a permit is required by this Code is 30 started or proceeded with prior to obtaining said permit, the 31 fees specified in Table No. 3-A shall be tripled, but the gay- 32 went of such triple fee shall not relieve any persons £rom -2- f 1 2 3 fully complying with the requirements of this Code in the execu- tion of the work nor from any other penalties prescribed herein. Table No. 3-A -- Building Permit Fees Total Valuation Fee $1.00 to $500.00 $5.00 5 $501.00 to $2,000.00 $5.00 for the first $500.00 plus g $1.00 for each additional $100.00 or fraction thereof, to and includ- 7 ing $2,000,. $ $2,001.00 to $25,000.00 $20.00 for the first $2,000.00 plus $4.00 for each additional $1,000.00 9 or fraction thereof, to and includ- ing $25,000.00. 10 $25,001.00 to $50,000.00 $112.00 for the first $25,000.00 plus $3.00 for each additional lj, $1,000.00 or fraction thereof, to and including $50,000.00. 12 $50,001.00 to $100,000.00 $187.00 for the first $50,000.00 .plus $2.00 for each additional 13 $1,000.00 or fraction thereof, to and including $100,000.00. 14 $100,001,00 to $500,000.00 $287.00 for the first $100,000.00 plus $1.50 for each additional 15 $1,000.00 or fraction thereof, to and including $500,000.00. lg $500,001.00 and up $887.00 for the first $500,000,00 plus $1.00 for each additional 17 $1,000.00 or fraction thereof. 18 Section 303(b) of said Uniform Building Code is hereby amended as 19 follows: 20 (b) Plan-checking Fees. When the valuation of the proposed 21 construction exceeds $1,000.00 and a plan is required to be 22 submitted by Subsection (c) of Section 301, a plan-checking fee 23 shall be paid to the Building Official at the time of submitting 24 plans and specifications for checking. 25 Plan-checking fees shall be one-half (1/2) the building permit 26 fee except that plan-checking fees will not be required on single 27 family residences, duplexes, and appurtenant structures. 28 Where plans are incomplete, or changed so as to require additiona 29 plan checking, an additional plan-check fee shall be charged at 30 a rate established by the Building Official. 31 (c) Expiration of Plan Check. Applications for which no permit 32 -3- ~ is issued within 180 days following the date of application shall 2 expire by limitation and plans submitted for checking may there- 3 after be returned to the applicant or destroyed by the Building ~ Official. The Building Official may extend the time for action ~ by the applicant for a period not exceeding 180 days upon 6 written request by the applicant showing that circumstances 7 beyond the control of the applicant have prevented action from 8 being taken. In order to renew action on an application after g expiration, the applicant shall resubmit plans and pay a new 10 plan-check fee. 11 Section 303 of said Uniform Building Code is hereby amended by 12 adding sub-section (e) as follows: 13 The building permit fees for factory-built housing shall be 14 computed in the same manner as for regular building construction 15 except that the fee shall be one-half (1/2) of the building lg permit fee determined by Table 3-A of said Uniform Building Code. 17 Section 303 of said Uniform Building Code is hereby amended by ,1g adding sub-section (f) as follows: 19 Where an owner or contractor desires an additional set of 20 approved building plans, the fee for this service shall be 21 five dollars ($5.00) for residential buildings, and ten dollars 22 ($10.00) for commercial buildings. 23 Section 303 of said Uniform Building Code is hereby amended by 2¢ adding sub-section (g) as follows: 2g Where an owner desires an inspection of a building on which 2g there is not an active building permit, for financing or other 27 purposes, the inspection fee shall be twenty-five dollars ($25.OD 28 per building. This fee shall be paid prior to the inspection. 29 This fee is to cover the cost of inspection and related admini- 30 strative costs only. Chapter 15 and Chapter 70 of the appendix of the Uniform Buildin Gode are hereby deleted. Sections 26-2 (as enacted by Butte County Ordinance 886), 26-4 (as enacted by Butte County Ordinance 970), 26-4.1 (as enacted by Butte County Ordinance 1159), 26-5 (as enacted by Butte County Ordinance 886), and 26-6 (as enacted by Butte County Ordinance 886) shall remain in effect. This ordinance shall take effect and be in force at the expiration of thirty (30) days from and after its passage and before the expiration of Fifteen (15) days after its passage shall be published once with. the names of the members voting for and against the same in a newspaper of general circula- tion printed and published in the County of Butte.
