The Board of Supervisors of the County of Butte do ordain as follows: Section 28-1 of the Butte County Code is amended to read as follows: Section 28-1. Plumbing Code - Adopted by reference. Except as hereinafter provided, that certain plumbing code known and designated as the Uniform Plumbing Code, 1973 Edition, together with appendices thereto, as prepared and published by the Interna- tional Association of Plumbing and Mechanical Officials is hereby referred to, adopted, and made a part of this chapter with the same effect as if fully set forth herein and is hereby declared to be the plumbing code of the County of Butte, and all-the provisions thereto shall apply to all of the unincorporated areas of the County of Butte. Section 28',=2 of the Butte County Code is amended to read as follows: Section 28-2. Same - Amendments, additions and deletions. The Uniform Plumbing Code as adopted by Section 28-1 of the Butte County Code is hereby amended to read as follows: Section 1.0 -Application and Scope The provisions of this code shall apply to all new construc- tion, relocated buildings, and to any alterations, repairs, or reconstruction, except as provided for otherwise in this code. Section 1.1 -Administrative Authority and Assistants Whenever the term "administrative authority" is used in this code it shall be construed to mean the Director of Public Works of the County of Butte or his authorized representative. Section 1.2 -Assistants Whenever the term "assistants" is used in this code it shall be construed to mean the duly appointed assistants of the Director of Public Works of the County of Butte. 1 2 3 4 51 6 7 8 9 10 lI 12 13 I4 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 1.3 -Department Having Jurisdiction Unless otherwise provided by law, the office of the Admini- strative Authority shall be the Department of Public Works of the County of Butte. Section 1.4 -Duties of the Administrative Authority The Administrative Authority shall maintain public office hours necessary to efficiently administer the provisions of this code and amendments thereto and shall perform the following duties: (1) Require submission of, examine and check plans and specifications, drawings, descriptions, and/or diagrams necessary to show clearly the character, kind and extent of work covered by applications for a permit and upon approval thereof shall issue the permit applied for. (2) deep a permanent, accurate account of all fees for permits issued and other monies collected and received as provided by this Code, the names of the persons upon whase account the same were paid, the date and amount thereof, together with the location or premises to which they relate. (3) Aduri~stex and enforce the provisions of this code in a manner consistent with the intent thereof and shall inspect all plumbing and drainage work authorized by any permit to assure compliance with provisions of this code or amendments thereto, approving or condemning said work in whale or in part as conditions require. (4) Tssue upon request a Certificate of Apgroval for any work approved by him. (5} Condemn and reject all work done or being done or materials used or being used which do not in all respects comply with the provisions of this code and amendments thereto. (6) Order changes in workmanship and/or materials essential -2- 1 to obtain compliance with ali provisions of this code. $ (7) Tnvestigate any construction or work regulated by this 3 code and issue such notices and orders as provided in ¢ Section 1.6. 5 (8) Keep a complete record of all the essential transaction g of his off ice. 7 (9) Transfer all fees collected by him to the proper 8 authority provided by law to receive such funds. g Section 1.5 -Right of Entry 10 The Administrative Authority and Assistants shall carry '13 proper credentials of their respective offices, upon 12 exhibition of which they shall have the right of entry, 13 during usual business hours, to insgect any and alI building 14 and premises in the performance of their duties. 15 Section 1.6 -Dangerous and Insanitary Construction lg (a) Any portion of a plumbing system found by the Admini- lq strative Authority to be insanitary as defined herein is 18 hereby declared to be a nuisance. lg (b) Whenever brought to the attention of the department 20 having jurisdiction that any insanitary conditions exist . 22 or that any construction or work regulated by this code 22 is dangerous, unsafe, insanitary, a nuisance or a menace 23 to life, health or property or otherwise in violation of 24 this code, the said department may request an imrestigation 2g by the Administrative Authority who, upon determining such 26 information to be fact, shall order any person, firm or 27 corporation using or maintaining any such condition or 28 responsible for the use or maintenance thereof to discontinu 29 the use or maintenance thereof or to repair, alter, change, 30 remove or demolish same as ~e may consider necessary for $1 the proper protection of life, health, or property and in 38 the case of any gas piping or gas appliance may order any ~g~ 1 person, firm or corporation, supplying gas to such piping 2 or appliance to discontinue supplying gas thereto until 3 such piping or appliance is made safe to life, health or ~ property. g Everp such order shall be in writing, addressed to the 6 owner, agent or person responsible for the premises in q which such condition exists and shall specify the date or g time for compliance with such order. g (c) Refusal, failure or neglect to comply with any such 10 notice or order shall be considered a violation of this 11 code. 12 (d) When any plumbing system is maintained in violation 13 of this code and in violation of any notice issued pursuant 14 to the provisions of this section of where a nuisance exists 15 in any building or on a lot on which a building is situated, 16 the Administrative Authority shall institute any appropriate 17 action or proceeding in any court of competent jurisdiction lg to prevent, restrain, correct, or abate the violation or 19 nuisance. 20 Section 1.7 -Violations and Penalties 21 The issuance or granting of a permit or approval of plans 22 and specifications shall not be deemed or construed to be 23 a permit for, or an approval of, any violation of any of 2¢ the provisions of this code. No permit presuming to give 2g authority to violate or cancel the provisions of this code 26 shall be valid, except insofar as the work or use which it 27 authorized is lawful. 2g The issuance or granting of a permit or approval of plans 29 shall not prevent the Administrative Authority from there- 30 after requiring the correction of errors in said plans and 31 specifications or from preventing construction operations 32 being carried on thereunder when in violation of this code -4- 1 or of any other ordinance or from revoking any certificate 2 of approval when issued in error. 3 Every plumbing permit issued under this code shall expire 4 by limitation and become null and void after one (1} year 6 from the date of issuance of said permit; provided, however, if said plumbing permit is issued in conjunction with a 6 7 building permit, said plumbing permit will remain active as long as the building permit is active. 9 Section 1.8 -Permit Required ld (a) It shall be unlawful for any person to install, 11 remove, alter, repair, or replace or cause to be installed, 12 removed, altered, repaired, or replaced any plumbing, gas, 'Z3 or drainage piping work or any fixture or water heating or 14 treating equipment in a building or premises without first obtaining a permit to do such work from the Administrative 15 18 Authority. , (b) A separate permit shall be obtained for each building ~ ~ 18 or structure. 19 (c) No person shall allow any other person to do or cause to be done any work under a permit secured by a Permittee 20 21 except persons in his employ. 22 Section 1.9 -Work not Requiring Permit No permit shall be required in the case of any repair work 23 as follows: The stopping of leaks in drains, soil, waste 24 25 or vent pipe, provided, however, that should any trap, 26 drainpipe, soil, waste or vent pipe be or become defective 27 and it becomes necessary to remove and replace the same 28 with. new material in any part ar parts, the same shah. be 29 considered as such new work and a permit shall be procured 30 and inspection made as hereinbefore provided. No permit 31 shall be required for the clearing of stoppages or the 32 repairing of leaks in pipes, valves or fixtures, when such -5- 1 2I 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 repairs do not invalve or require the replacement or rearrangement of valves, pipes, or fixtures. No permits shall be required for any agricultural building Agricultural buildings are defined as follows: 'Agricul- tural building is a building located on agricultural pro- perty and used to shelter farm implements, hay, grain, poultry, livestock, or other farm produce, in which there is no human habitation, is not used commercially, and which is not used by the public.` No permits shall be required for detached structures which have a total net area, including additions, of not more than two hundred (200) square feet, which would have an occupancy classification of Type J as defined in the Uniform Building Code, and which would be detached a mini- mum of six (6) feet from any building requiring a building permit. This exemption shall apply to tool sheds, wood sheds, and pump houses. This exemption shall not apply to carports and garages. Section 1.10 -Application for Permit Any person legally entitled to apply for and receive a permit shall make such application on forms provided for that purpose. He shall give a description of the characte of the work proposed to be done, and the location, owner- ship, occupancy and use of the premises in connection therewith. The Administative Authority may require plans, specifications, or drawings and such other information as he may deem necessary. Zf the Administrative Authority determines that the plans, specifications, drawings, descriptions or information furnished by the applicant is in compliance with this coy he shall issue the permit applied for upon payment of the required fee as hereinafter fixed. -6- i 2 3 4 5 6 7 8 9, 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 28 26 27 28 29 30 31 32 Section 1.11 -Cost of Permit Every applicant for a permit to do work regulated by this code shall state in writing on the application form pro- vided for that purpose, the character of work proposed to be done and the amount and kind in connection therewith, together with such information, pertinent thereto as may be required. Such applicant shall pay for each permit issued at the time of issuance, a fee in accordance with the following schedule, and at the rate provided for each classification shown herein. Any person who shall commence any work for which a permit is required by this code without first having obtained a permit therefor shall, if subsequently permitted to obtain a permit, pay triple the permit fee fixed by this section for such work, provided, however, that this provision shat not apply to emergency work when it shall be proved to the satisfaction of the Administrative Authority that such wor was urgently necessary and it was not practical to obtain a permit therefor before the commencement of the work. In all such cases, a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such permit, a triple fee as herein provided shall be charged. For the purpose of this section, a sanitary plumbing out- let on or to which a plumbing fixture or appliance may be set or attached shall be construed to be a fixture. Fees for reconnection and retest of existing plumbing systems in relocated buildings shall be based on the number of plumbing fixtures, gas systems, water heaters, etc., involved. Such 16 notification shall be given not less than twenty-four (24) ],7 hours before the work is to be inspected. 18 It shall be the duty of the person doing the work authorized lg by the permit, to make sure that the work will stand the 20 tests prescribed elsewhere in this code, before giving the 21 above notification. 22 Sections 28-3 and 28-4 (as enacted by'Butte County Ordinance 888) shall 23 remain in effect. 2¢ This ordinance shall take effect and be in force at the expiration of 25 thirty (30) days from and after its passage and before the~expiration of 26 fifteen (15) days after its passage shall be published once with the names 2'7 of the members voting for and against the same in a newspaper of general 28 circulation printed and published in the County of Butte. 29 30 31 32 -9- 1 PASSED AND ADOPTED this 17th day of ~.: December , 2 19 7~ by the following vote: 3 Ayes: Supervisors Cameron, Gilman, Zadd, McKillop and Chairman Madigan ¢ Noes: None 6 Absent: None s ~),. ~ c v~ q airman of the Boar of Supervisors, County of Butte 8 ATTEST: 9 Clark A.
