AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "TM-2" (TIMBER-- MOLTNTAIN) DISTRICT 1 The Board of Supervisors of the County of Butte, State 2 of California, under and pursuant to Ordinance No. 475, as amended 3 .. and declaring an emergency, DO ORDIAN, as follows: 4 SECTION 1. The hereinafter described area situated in- s the County of Butte, State of California, shall be and it is here- 8 by zoned as a "TN{y2" (Timber--Mountain) Di.s~,rict for a period of ~ 120 days, and such area shall be subject to the restrictions and 8 restricted uses and regulations hereinafter specified and provided 9 Said area so zoned being located at Forest Ranch, and 10 more particularly described as follows: 11 All of Sec 5 and Sec 5, T23N, R3~;:. MDB&M, and all of 12 - Sec 31 and Sec: 32, T24N, R3E, MDB&M:•~ 'Excepting therefrom; the NEB of the ~SE~ and the SE's . ~.3 of the NE's of Sec 6 , T23N, R3E, MDB&M 14 Also excepting-therefrom; the NW's of Sec 5, T23N, R3E, ~1DB ~M . 15 -.Also excepting therefrom all that property on both sides of and within 3S0 ft. of the centerline of Hwy. 16 32. 17 18 I9 SECTION 2. The following regulations shall apply in a 20 "TM-2 " (Timber-Mountain) District: 2~. 2 . ~. USES PERMITTED 22 a. Single-family dwellings, including mobile homes. 23 b. Keeping and raising small animals for domestic use, including dogs, cats and household pets, poultry and other birds, bees, fish and frogs. d. Keeping, raising and pasturing of cattle, horses. sheep, goats, hogs or other livestock, provided that no more than two (2} such animals be kept per acre on parcels of less than five (5) acres and no more than.faur (4} such animals be kegt per acre on par- ce is of five ( 5 ) acres or more . e. Prospecting, claiming, drilling, mining, excavating and dredging of mineral, hydrocarbon and geothermal resources, except as limited in 2.2. f.. P=ntection of land and forests from fire, erosion, floods, slides, quakes, insects, diseases and pollu- tion, including arboretums and natural wilderness, experimental and study areas. g. display and sale of products of agricultural uses and home arts and crafts produced on the premises. h. Accessory uses, improvements and structures Gusto-- mary and pertinent to permitted uses, except as limited in 2.2, including guest houses, barns, shed; shops, garages and storage areas. 2.2 USES PERMITTED SUBJECT TO FIRST SECURING A USE PERM IN EACH CASE: a. Commercial wood processing plants. c. Commercial kennels and animal hospitals. d. Commercial livestock feed yards, e. Animal product processing plants. f. Mining, quarrying and excavating activities which might be objectionable by reason of noise, odor, smoke, dust, bright light, vibration, stream pollu- tion or handling of explosives or dangerous material: g. Commercial boat ramps, docks and landing facilities. h. Aircraft landing facilities, i, Disposal areas and sewage treatment facilities. ~. Fublic and quasi-public uses including schools, park; playgrounds, recreational facilities, utility system structures, meeting halls, hospitals, libraries, museums, government offices and similar uses.' k, Private or commercial outdoor recreation facilities on sites of not less than five (S.y acres, including • country clubs, golf courses, riding academies and stables, hunting and fishing camps and other clubs, and gun clubs and ranges. 2.3 L4T AREA: Minimum required area of a lot per dwelling unit _~.. ~. 1 2 3 4~ 5 6 7 8 9 10 11 12 13 14 15 18 17 18 I9 20 21 22 23 24 2~ 26 shall not be less than two (2) acres for "TM-2". 2.4 LOT WIDTH REQUIRED.:... _.. . Minimum required lot width shall not be less than sixty-five {65) feet. 2.5 FRONT YARD REQUIRED: Minimum required front building setback shall be not less than fifty (50) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum required front building setback shall be not less than fifty-five {55) feet from the centerline of the road. 2.6 SIDE XARD REQUIRED: Minimum required side bu~.lding setback shall be not less than five (5 ) feet fo~:~~,"TM-2" . 2.7 REAR YARD REQUIRED: Minimum required rear budding setback shall be not less than five {5} ft. for "TM=2". SECTION 3. All uses of land not specifically authorized and permitted in Section 2 are prohibited. SECTION 4. rn compliance with the provisions of said Zoning Enabling Ordinance, the same is hereby amended by adding this ordinance in full. SECTION 5. Tn compliance with the provisions of the Zoning Enabling .Ordinance, this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance . SECTION 7. This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen (15) days after its passage shall.be published once with the: names of the members of the Board of Supervisors voting for and against the same in the Chico Enterprise-Record , a news- paper in general circuhation in the County of Butte, State of California. The facts constituting the urgency on which this Ordinance is based are: 1. That the area is presently under study for rezoning. 2. To be more consistent with the present land use.
