HomeMy WebLinkAbout15461. 2 3 4 5 8 7' S 9 to lI 12 13 14 15' 16 17 18 19 20 21 ,` 22 ~ 23 24 ~Il 25 28 ORDINANCE N0. ~5~-6 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN AR-MH (AGRiCULTURAL- RESIDENTIAL-MOBILE HOME) DISTRICT, PURSUANT TO ORDINANCE NO. 475, AS AMENDED The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475, of said County, being the Zoning Enabling Ordinance of said County, as amended, DO ORDAIN as follows: SECTION 1. The hereinafter described area, situated in the County of Butte,State of California, shall be and it is hereby zoned as an "AR-MH" (Agricultural-Residential-Mobile Home) District, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided Said area so zoned being located in the unincorporated area of Butt=County, south of Oroville, more particularly described as follows: District: That portion of the r~i~~~ ~7Q~~-~tt~ Of the S'~ of Sec 32, T19N, R4E, MDB&M, located on the east side of Lincoln Blvd. and within 132Q ft. of the centerline of Linco°ln Blvd. Containing SO acres, more or less. SECTION 2. REGULATIONS FOR AN "AR-MH" DISTRICT: The following regulations shall apply in an "AR-MH" 2 . ~. USES PERMITTED a. Single-family dwellings . b. Mobile Homes - to house one family, when such mob home is the only housing facility located on the premises, provided the following conditions are conformed to: -1- /sy~ ` 1 2 3 4 5 6 7 8 9 ~a 1I x2 I3 I4 I5 16 ~.7 18 ~.s 20 21 22 23 24 2b 26 1) The gross area of the mobile home shall not be less than--500 sq. ft. 2) All sanztary facilities shall conform to State Statutes and regulations and to local require- ments of the Butte County Health Department. 3) All electrical installations shall conform to State Statutes and regulations as administered by the Building Division of the Butte County Public Works Department. c. Accessory buildings pertinent to the permitted uses. d. Agricultural uses, e. Livestock, subject to requirements as follows: 1) Minimum Iot area to be devoted to residential use shall be not less than eight thousand, one hundred twenty-five ( $,125) sq . ft . 2) Exclusive of the area devoted to the residential use, the following lot or parcel areas shall be required for each animal raised or kept on the premises a) For Qach horse or head of cattle over one (1) year of age -eight thousand one hundred twenty-five ($,125) sq. ft. b) For each head of swine°:over ten (10) weeks of age - eight thousand, one hundred twenty- ~i~re (8,125) sq. ft. c) For each head of sheep or goats - two -2- . . i 2 3 4 5 6 7 8 9 ZO 11 12 '~ 13 i4 15 16 17 18 19 20 21 22 23 24 26 28 thousand {2,000) sq. ft. 2.2 THE FOLLOTAING USES SUBJECT TO SECURING A USE PERMIT IN EACH CASE: a. Duplex dwellings and multiple-family dwellings. b. Golf courses, country clubs, if permitted, would permit accessory uses such as driving range, pro shop, cocktail bar, restaurant. c. Public and quasi-public uses including churches, ~', firehouses, hospitals, parks and playgrounds, schools, and public utility buildings. d. Commercial poultry farming and livestock farming. e. Veterinary clinics, outpatient. f . Nurseries and plant gardens . 2.3 LOT AREA REQUIRED: Minimum required area of lot per dwelling unit shall be not less than eight thousand, one hundred twenty- five (8,].25) sq, ft. 2.~ LOT WIDTH REQUIRED: Minimum lot width shall be not less than sixty-five {&5) ft. 2.5 FRONT YARD REQUIRED: Minimum front yard shall be fifty (50} ft. from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum building setback requirement shall be fifty-five (55) ft. from the centerline of the -3- 1 2 3 4 fi 6 7 8 9 10 11 12 13 14 15 16 17 18 is 2Q 21 22 23 24 23 2B road. 2.6 SIDE YARD REQUIRED: _.. Minimum side yard shall not be Less than five- 5 t SECTION 3. All uses of Land within the district not specifically authorized and permitted in Section 2 are prohibited. SECTION 4. In compliance with the provisions of the Zoning Enabling Ordinance, the same is hereby amended by adding this Ordinance in full. SECTION 5. The penalties for the violation of the zon- ing hereby unposed within the district -shall be. as provided in the Zoning Enabling Ordinance. In compliance with-the provisions of the Zoning Enabling Ordinance, this ordinance shall be from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 6. This ordinance shall be and it is hereby declared to be in full force and effect from and. after thirty t 30 ) days after the date of its passage, and before the expiration of -- fifteen (.15) days after its passage, this ordinance shall be pub- lished once with the names~of the members of the Board of Super- visors voting for and against it in the Orovi~.~.e Mereur a newspaper published in the County of Butte, State of California.
