RESOLUTIO 1AUTHORIZING ASSESSME IT OF PA'KING 'El ALTY RELATED TO SECTION 1465.5 OF THE

W 11EREAS, Penal Code Part 2. Of Criminal Procedure Title 11. Charter 1. Section 1465,5 directs
that an assessment of two dollars ($2)for every ten dollars ($10) or fraction thereof, for every fine,
forfeiture, or parking penalty imposed and collected pursuant to Section 42001.13 of the Vehicle Code
for violation of Section 22507,8 of the Vehicle Code, may be imposed by each county upon the adoption
of a resolution by the board of supervisors; and
WHEREAS, an assessment imposed by this section shall be collected and disbursed as provided
in Section 9545 of the Welfare and Institutions Code; and
WHEREAS, Welfare and Institutions Code Section 9545 (a) provides that, the Legislature finds
and declares that the purpose of the Linkages Program shall be to provide care and case management
services to frail elderly and functionally impaired adults, with priority for enrollment given to low-
income individuals, to help prevent or delay placement in nursing facilities; and
WHEREAS, pursuant to Welfare and institutions Code Section 9545(d)(1), each county shall
deposit funds collected pursuant to Section 1465.5 of the Penal Code in its general fund, to be available
for use only for the support of services provided under this chapter(Linkages Program) in that county,
including county ad inistrative costs not exceeding 10 percent of the funds collected, except as
otherwise provided in this subdivision.
NOW,THEREFloRE, tE IT RESOLVED by the Board of Supervisors of the County of Butte that:
1. The foregoing recitals are adopted as part of this resolution.
2. Implementation of the provisions of Section 9545 of the Welfare and institutions Code is
necessary to the establishment of the Linkages Program in the County.
3. Pursuant to these laws,the Board of Supervisors herein designates that from every ten
dollars ($10) of penalty collected pursuant to Penal Code 1465.5, two dollars ($2) shall be
deposited to the County for the Linkages Program,
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of California,
this 12th day of January 2016, by the following vote:
