AP i"^LYING Tri'E AG II""ICLT ,' °n;,L t''UFF ;R TO ALL, WILLIA''1 nIS N ACT NT ',. 1,CTS WHEREAS, on October 26, 2010 Butte County adopted a new Gey eral Plan (General Plan 2030), including a new General Plan 2030 Land Use Ma ; and W t N P!',r AS, General Plan 2030 is a coy nprehensive, long-term general plan for Butte County and establishes an overall framework and set of land use planning goals for the unincorporated area of the County, General Plan 2030 has a 20-year planning horizon; and. HER ti.AS, General Plan 2030 is intended to be a living, dynamic, and comprehensive document; and WO'E E 1.II AS, on. September 27, 2012, the Planning Commission made recorm 1'endations to the is oard of Supervisors and on November 6, 2012 the 'oard of Supervisors adopted amendments to the General Plan 2030 under Resolution No. 12-124 and adopted the Zoning Ordinance Update under Ordinance No. 4050, and Certified a Final Supplemental Environmental. Impact Report (SEI ..) under Resolution No, 12-123; and W!ItaEll,.f AS,on April 1,2015,. a Notice of Preparation(NOP) of a SF,IR for a General Plan Amendment (GPA) to Agricultural Element Policy AG-P5.3 (Agricultural Buffer), and the inclusion of new policies AG-P5.3.1 and AG-P5.3,2, and related amendments to the Zoning Ordinance was sublitted to the State Clearinghouse(SCH 42.015042004)for circulation to public agencies for comment. The NOP comment period extended from April 1, 2015 to April 30, 2015; and WHEREAS„ on June 17, 2015, a Draft SEP' (SCH 42015042004) for this project was circulated to the State Clearinghouse, responsible agencies and interested parties for a 45-day review period; and WHEREAS, on July 30,2015, a public hearing on the Draft SEIR for this project was held before the Butte County Planning Commission to accept verbal and written comment on the Draft SEIR in accordance with the Butte County Environmental Review Guidelines. A total of nine comment letters were received on the Draft SEIR in addition to verbal comment presented at the public hearing; and WHEREAS, on October 9, 2015, Butte County released the Final SEIR and the County provided notice of the availability of the Final SEIR to agencies,organizations, and the public; and WHEREAS,on October 22,2015,November 12,2015,and December 10,2015,the Butte County Planning Commission conducted public hearings concerning recommendations to the Board of Supervisors on the proposed GPA and proposed amendments to the Zoning Ordinance and the Final SEIR,and on December 10,2015 recommended that the Board of Supervisors certify the Final SEIR for the proposed amendments to the General Plan and Zoning Ordinance. NOW, THEREFORE, BE IT RESOLVED,that the Butte County Board of Supervisors hereby makes the following findings: 1. Notice of the Board of Supervisors hearings on the GPA, Zoning Ordinance Amendments, Draft SEIR, and Final SEIR were given as required by law and the actions were conducted in accordance with CEQA and the State CEQA Guidelines. 2. All individuals, groups, and agencies desiring to comment were given adequate opportunity to submit oral and written comments on the GPA, Zoning Ordinance Amendments and the environmental review documents. These opportunities for comment meet or exceed the requirements of the Planning and Zoning Law and CEQA. 3. All comments submitted during the public review and comment period on the Draft SEIR were responded to adequately. 4. The Board of Supervisors was presented with all of the information described in the recitals and has considered this information in adopting this resolution. 5. The Final SEIR(a)has been completed in compliance with the intent and requirements of CEQA and the State CEQA Guidelines, (b) reflects the independent judgment and analysis of the County of Butte, which is the lead agency, and (c) has been presented to and reviewed and considered by the Board of Supervisors in its deliberations regarding the recommendation for adoption of the GPA and Zoning Ordinance Amendments.
