RESOLUTION AME DING THE MATC; PORTION OF FLII 'DING FOR THE
JAIL PROGRAM, INMATE TREATMENT, CAPACITY AND RE,LACEMENT HOUSING PROJECT
UNDE-; SB 863 FINANCING PROGRAM
WHEREAS, the Sheriff maintains the safety of the community and operates the county jail in a
safe and humane manner and recognizes the S; 863 Financing Program assists counties in providing
upgrades to jail facilities to replace outdated, compacted housing and provide space for evidence-
based treatment programs for inmates; and
WHEREAS, on August 11, 2015, the hoard of Supervisors of Butte County passed and
adopted a Resolution authorizing the submission of an application for funding of the Jail Program,
Inmate Treatment, Capacity and Replacement Housing Project (Project) under the SB 863 Financing
Program, including required assurances; and
WHEREAS, the County of Butte (County) has received conditional approval from the Board of
State and Community Corrections (BSCC) for an award in accordance with the SB 863 Financing
Program for partial funding of the Project in the amount of $40 million; and
WHEREAS, the conditional approval from BSCC questioned the legality of using Inmate
Welfare Funds to be included in the County's required match funds for the Project, and requested the
County further explore the legality of using Inmate Welfare Fund monies, and encouraged the County
to find an alternate source for those funds; and
WHEREAS, Butte County Counsel has researched the issue and found the proposed use of
Inmate Welfare Funds for a portion of the match to be within the bounds of the law; and,
WHEREAS, while the County maintains that the use of the proposed funds is within the
bounds of the law, to avoid unnecessary delay and obstruction of this much-needed project, the
County will use an alternate source for the Inmate Welfare Fund portion of matching funds.
NOW, THEREFORE, BE IT ESOLVED that the Board of Supervisors of utte County hereby
authorizes the replacement of $685,000 in cash matching funds from the Inmate Welfare Fund with
$685,000 from the County's Local Assistance for Rural and Small County Law Enforcement Funds,
as noted in the updated chart below:
