RESOLUTICY1AUr,1ORIZING THE SALE OF REAL PROPERTY FROM
THE COUNTY OF 1,uTTE TO THE SHERWOOD MONTESSORI SCHO•I
WHP EAS, the County of Butte purchased the real property identified as Assessor's parcel number 005-417-01.6,
with a physical address of 1010 Cleveland Avenue,Chico,California 95928("Property"),in 1997 with the intent to demolish
the existing structures and using Community Development Block Grant ("CDBG") funds partner with the City of Chico to
construct a new Chapman Neighborhood Community Center in support of what is now known as the Chapman/Mulberry
Neighborhood Plan. The application for the CDBG funds was subsequently denied and without a funding source the
construction project could not go forward; and
WHEREAS,the Board of Supervisors in keeping with the purpose of the acquisition,entered into lease agreements
with various entities that provided services to the Chapman/Mulberry Community until January 2014 when the Property
became vacant; and
WHEREAS, on February 23, 2016, the Board of Supervisors accepted a Special Use/Vacant Facilities Report as
presented by the General Services Department. Included in that report was the Property which was determined to be
functionally obsolete and surplus to the needs of the County. The General Services Department having exhausted all other
options for disposal of the Property recommended to and received approval to offer the Property for sale by public auction
knowing that the cost to sell the Property could exceed the proceeds from the sale; and
WHEREAS, on March 23, 2016, the General Services Department received a letter of interest from Sherwood
Montessori; a 501(c)(3) public benefit California corporation, Tuition-Free Public Charter School authorized by the Chico
Unified School District under the conditions of proposition 39 to occupy Chapman Elementary School which is adjacent to
the Property. Sherwood Montessori desires to purchase the Property"As is, Where Is" for SL00 plus closing costs to use
the Property as part of their educational program to deliver a high quality Montessori-method education to over 150
children; grades K through 8; and
WHEREAS,Sherwood Montessori's intended use would provide a much needed benefit to the Chapman Mulberry
Community and would be consistent with the Chapman/Mulberry Neighborhood Plan.
NOW,THEREFORE, BE IT RESOLVED, by the Board of Supervisors:
1, Approve the request from Sherwood Montessori to purchase the Property.
2. Convey the Property pursuant to CA GC§25365. (a) Upon the price and terms herein stated.
3. Authorize the Director of General Services, to execute all documents necessary to convey the Property
and close the escrow.
PASSED AND ADOPTED by the Butte County Board of Supervisors, this 10th day of May, 2016, by the following
vote:
AYES: Supervisors Wahl, Kirk, Lambert,Teeter, and Chair Connelly
