HomeMy WebLinkAbout16-085 onxbwali: ploe,g14,44,11 nii'14%'115!, :,,,111111,VOtpFlOg'1444;&'1 riON$004/A 1)'1; 1#4"741'461°4111(111AligiftiatA,t5AiSreilVttqtigVg*FVglititoqtkOMitalgViO4PZVR frlrjaOrM*kPAAUft;4000,,,g::0$A#M%4::XIM%ir9qr:NgMSba*%WRROPM //fi:ltrIt0014°N I Resolution No. 16-085 xli.t,',;;# RESOLUTION OF THE BOARD OF SUPERVISORS OF T E COUNTY OF BUTTE AITROVING A COMPENSATIE1A AGREEMENT WITH THE CITY OF OROVILLE FOR PROPERTIES TO BE INCLUDED IN THE GATEWAY DEVELOPMENT i'OJECT WHEREAS, the City of Oroville (the "City") and Snyder Real Estate Holdings, LLC (the "Developer") entered into a Master Disposition and Development Agreement (the "MDDA") providing for the development by the Developer of a commercial and retail project commonly referred to as the "Gateway Project"; and WHEREAS, the Gateway Project which will include a hotel, restaurant, and a mixture of commercial and retail spaces, presents a unique catalyst development opportunity for the continuing success and vitality of downtown Oroville and has been a vision of the City for many years; and WHEREAS, development of the Gateway Project will not only enhance downtown Oroville, hut will also provide significant revenues for all affected taxing entities; and WHEREAS,the Gateway Project includes four parcels of land (the "Property) owned by the City as shown in Exhibit A, including two parcels formerly owned by the °ravine Redevelopment Agency; and WHEREAS, the process for disposition of any property formerly owned by the Oroville Redevelopment Agency is governed by the Oroville Successor Agency's Long Range Property Management Plan, which was approved by the Oroville Oversight Board on December 17, 2014; and WHEREAS, in order to provide for the contribution of the Property to the Gateway Project, the City entered into a MDDA providing for the sale of that property to the Developer for the sum of $1.00, which represents the fair reuse value of the property in light of the covenants, conditions and development costs required by the MDDA; and WHEREAS, the Oroville Successor Agency's Long Range Property Management Plan requires that prior to the sale of the Property, the City shall enter into compensation agreements with all the affected taxing entities; and WHEREAS, the taxing entities that will benefit from the development of the Gateway Project (the "affected taxing entities") are listed in Exhibit : together with their respective property tax shares; and WHEREAS, the transactions contemplated by the MDDA are contingent upon final approval by the State of California Department of Finance ("DOF"). NOW,THEREFORE BE IT RESOLVED, the Butte County Board of Supervisors resolves the following: Section 1. The Butte County Board of Supervisors hereby finds that the Gateway Project will be of substantial benefit to the City of Oroville and all of the affected taxing entities, and does hereby express its support for the contribution of the Property to the Gateway Project. Section 2. The Butte County Board of Supervisors hereby finds and determines that the sale of the Property (Exhibit A) to the Developer for the Gateway Project for the sum of $1.00 ("disposition price") is approved. Section 3. The Butte County Board of Supervisors hereby determines that this resolution shall constitute the compensation agreement with the City to the extent required by Health and Safety Code Section 34180(f) and directs that a copy of this resolution be provided to the City.
