HomeMy WebLinkAbout1610i ORDINANCE N0. 1&l0 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF 1 BUTTE, STATE OF CALIFORNIA, A "C-C" (COMMUNITY COMMERCIAL} DISTRICT, PURSUANT TO ORDINANCE NO. 2 4?5 __ Thee Board of Supervisors of-the County of Butte, State 3 4 of California, under anal pursuant to Ordinance No. 475, of said 5 County being the Enabling Ordinance, DO ORDAxN as follows: 6 SECTION 1. The hereinafter descri bed area, situated in 7 the County of Butte, State of California, shall be and it is 8 hereby zoned as a "C--C" (Community Commercial) District, and such ~ area shall be subject to the restr~,ctions and restricted uses and 10 regulations here~,nafte r specified and provided. Said area sa 11 zoned being located in the unincorporated area of Butte County, 12 near Paradise, more particularly described as: 13 Lot 5 of Paradise Springs, Unit ~1 per map of record in Map Book 18, Pages 51 and 52 of the Butte County 14 Recorder. 15 That portion of the W~ of the W~ of the SW4 of Sec 24, ' T23N, R3E, MDB&M, located east of Skyway and north of 16 Perry Road,. containing 7,5.acres, more or less. 17 SECTION 2. REGULATIONS FORA "C-C" DISTRICT: 18 The following regulations shall apply in an "C-C" lg (Community Commercial) District: 2p 2.1 Uses permitted subject to plan approved by the 21 Plann~.ng COmm?5siori: 22 a. Multiple dwellings and dwelling groups, subject 23 to the height limit, build~.ng site area, average 24 lot width and yard requirements specified for 26 R-3 Districts. 2fi b . Retail stores and shops of a light commercial _. character and condi~ctad wi thin a build? ng ~.n- chiding appl-lance stores, banks, barber shops, beauty parlors, book stores, cleaner of laundry agents and launderettes, dress shops, drug stores, food stores, furniture stores, millinery sla;opsr professional offices, restaurants, re- freshment stands, service stations, shoe shops, storage garages, studios and tailor shops, pub- lic utility commercial offices, and other uses which are of similar character to those enumera- ted and which will not be detrimental or obnox~ ious to the neighborhood in which they are located. d. The following uses subject to securing a use permit in each case: 1. All uses permitted in "R-l" and "R~-2T` Districts . 2 . ASobile Home Parks . 3. Public and quasi--publac uses. 4. Animal hospitals, auto sales, dancing aca- demies or halls, - open--air retail sales, theaters, pst shops, wholesale stores, or storage undertaka~ng establishments, used car sales, used or seconda~hand goods and ~~- 1 other uses which are of similar character. 2 2.2 BUILDING HEIGHT LIMIT: 3 Forty-five (45) feet, 4 2.3 LOT WIDTH REQUIRED: 5 Minimum lot width required is twenty-five {25) ft. 6 2.4 FRONT YARD REQUIRED: 7 None except where frontage in a block is partially 8 in an "R" District, in which case the front _yard 9 shall be one-half that required in such "R" Dis trict 10 2.5 SIDE YARD REQUIRED: I1 None, except where the side of a lot abuts upon the 12 side of a lot in an "R" District, in which case the i, 13 abutting side yard shall be not less than five {5} 34 feet, anal except where the side yard on the street 15 side of a corner lot abuts on an "R" District, in 16 which case the .side yard on the street side shall 17 be one-half the corresponding front yard required 18 in such "R" Districts. 19 2 .5 REAR YARD REQUIRED 20 Twelve {12} feet, or f~.ve {5) feet adjacent to an 2I alley . 22 2.7 OFF-STREET PARKING: 23 Off-street parking area shall be approved in ad- 24 vance and as required by the Planning Commission. 28 2.8 FENCES, SCREEN PLANTINGS, ETC.: 28 Fences, screen plantings, .and other obstructions, -3- 1 z __ 3 4 6 6 7 S s 10 11 12 13 14 15 1B 17 1$ 19 20 21 22 23 24 23 26 shah. not exceed three {3) feet in height in .front .-...yards,- nor six (6) feet in height in any required rear or side yards . In the case of corner Lots, fences, shrubs, screen plantings or similar obstruc- tions shall not exceed three {3) feet in height within the sight distance area. SECTION 3, All uses of land not specifically authorized and permitted under Section 2 are prohibited within the district. SECTION 4. In compliance with the provisions of the Zoning Enabling Ordinance, the salve is hereby amended by adding this Ordinance in full. SECTION 5. The penalties for the violation of the Zoning hereby imposed within the district shall be as provided in the Zoning Enabling Ordinance. In compliance with the provisions of the Zoning Enabling Ordinance, this ordinance shall be from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION b.
