HomeMy WebLinkAbout16-101 a,wJ, fl¢1,s/l�l��✓U;'i,'J.r0;fY'..1,'('sI'/- ,i�.,l ,�,, ar , r/n,I ( l/r y. 4/07 � , Ji / � e,l,,.0 � ,i,1rc7 / //IN, 1 !,"Fr,/,* i:i /"1,7 "fir �1r� � I � ; � � �/� �� ? or� aflI� � � �� � 1 'l 1�i / Y�� � y`�/ri �7��1/ f '1,/,1,06/410/ 1 �yL/;i ,j / /i ,l�i ;� , � � l/ fn ��1/./✓rrill/il //� il ldr ,�� / � a ' , / � f1 0rl �,1 a ,70 1 0!�/ 000"� i��// r 0 /A�%fl� /�, � ��/ ��r/,�4i � *h, 3 r 1 ,� M Resolution No. 16-101 deP A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS ADOPTING THE NEGATIVE DECLARATION FOR CODE AMENDMENT CA16-0001 AMENDMENT OF THE BUTTE COUNTY CODE, CHAPTER 20 TO AMEND BUTTE COUNTY CODE 20-133 TO ALLOW ADDITIONAL EXCEPTIONS TO CUL-DE-SAC LENGTH STANDARDS WHEREAS, the Board of Supervisors has considered proposed Code Amendment CA16-0001 to allow modifications to length of cul-de-sac standards in Butte County Code (BCC) section 20-133 in conformance with State Public Resources Code section 4290, and California Code of Regulations, Title 14 Natural Resources, Division 1.5 Department of Forestry, Chapter 7 Fire Protection, Subchapter 2 SRA Fire Safe Regulations; and WHEREAS, staff has prepared amendments to Butte County Code Chapter 20 in consultation with Butte County Public Works, Butte County Fire Department/CalFire, County Counsel, and other affected agencies and individuals; and WHEREAS, the Planning Commission considered CA16-0001 on May 26, 2016, and recommended the proposed amendments to Butte County Code to amend to BCC section 20-133 to allow an additional exception to cul-de-sac length standards with approval of Butte County Fire Department/CalFire,generally consistent with CAL FIRE (State) standards for exceptions to cul-de-sac standards; and WHEREAS, the Board of Supervisors has considered Code Amendment CA16-0001 and a Negative Declaration prepared for the project in accordance with the California Environmental Quality Act (CEQA); and WHEREAS, said code amendments were referred to various affected public and private agencies,County departments, and referral agencies for review and comments; and. WHEREAS, a duly noticed public hearing was held on July 26, 2016, and the Board of Supervisors has considered public comments,the recommendation of the Planning Commission, and a report from the Planning Division. NOW,THEREFORE, BE IT RESOLVED, that the Board of Supervisors take the following actions: Adopts a Negative Declaration with the following findings: A. An Initial Study was completed in compliance with CEQA. Said study identified no significant environmental effects. B. The Board of Supervisors has considered the Negative Declaration, together with comments received during the review process. C. On the basis of the whole record before the Board of Supervisors, including the Initial Study and any comments received, there is no substantial evidence that the Code Amendment CA16-0001, would have a significant impact on the environment. The custodian of the record is the Department of Development Services. The location of the record is 7 County Center Drive, Oroville CA 95965. D. The Negative Declaration reflects the independent judgment and analysis of Butte County, which is the Lead Agency. II. Finds that the collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is required prior to filing a Notice of Determination for the project, unless verification from the California Department of Fish and Game is provided that the project is exempt from the fee requirement. If a required fee is not paid for the prject,the prject will not be operative,vested or final and any local permits issued for the project will be invalid (Section 7I1.4 (c) (3)).
