HomeMy WebLinkAbout16-143 '14'014 '!/e,14VAtie ir446„04,* III''4:(OHQ,?ft46/104A#01004, 'ipiet/414'; '16/Ir'"1 F;44/1:N1 ,0:4e100/11,40,7t4a4 9I/00A4g, PANt 71,,Cifi#K41:#W01A,*#! *41014/.0m90,1/0"9:11;;ANItttg0 ' 0,41 '';4 41,1)'4144,44';':147,040,*ii+g4 `7,ZIA,4,4AeiAtAlegoOt/t/eAKv6A'ofogitoamot?Aldikiavizaokea '(4404AAv 0',144/g4: Resolution No. 16-143 RESOLUTION AUTHORIZING USE OF RULE 20A CREDITS ALLOCATED BY PACIFIC GAS AND ELECTRIC COMPANY TO THE COUNTY OF BUTTE IN THE CITY OF CHICO PURSUANT TO DECISION NOS. 73078 AND 82- 01-18 OF THE CALIFORNIA PUBLIC UTILITIES COMMISSION FOR UNDERGOUND UTILITY DISTRICT NO. 18 WARNER STREET WHEREAS, per Section 14.44.020 of the Chico Municipal Code of the City of Chico, a public hearing was called August 2, 2016, at the hour of 6:00 p.m., in the City of Chico City Council Chambers, 421 Main Street, Chico, California, to ascertain whether the public necessity, health, safety, or welfare required the removal of poles, overhead wires and associated overhead structures, and the undergrounding of wires and facilities for supplying electric, communication, or other similar or associated service, within that certain area of the City of Chico on Warner Street from West 2nd Street to West Sacramento Avenue; and WHEREAS, notice of such hearing was given to all affected property owners and utilities concerned in the manner and for the time required by law; and WHEREAS,such hearing was duly held, and all interested persons were given an opportunity to be heard; and WHEREAS, the City Council of the City of Chico, pursuant to Resolution 75-16 of the City of Chico, has declared and determined that certain area within the City of Chico described as Underground Utility District No. 18 - Warner Street (West 2nd Street to West Sacramento Avenue,) as more specifically described in Exhibit "A" and delineated in Exhibit "B" attached and entitled "CITY OF CHICO, UNDERGROUND DISTRICT NO. 18, WARNER STREET, (WEST 2ND STREET TO WEST SACRAMENTO AVENUE)",to be an underground district for conduits,wires, and associated appurtenances for the purpose of supplying electric, telephone, cable television, and other similar or associated service by means of electrical materials or devices; and WHEREAS,the Underground Utility District created by said Resolution 75-16 of the City of Chico is in the general public interest for the following reasons: 1. The undergrounding to be accomplished will avoid or eliminate an unusually heavy concentration of overhead distribution facilities; 2. The streets, roads, or rights-of-way in the district are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic; and WHEREAS, the area contained within Underground Utility District No. 18 - Warner Street (West 2nd Street to West Sacramento Avenue) is of particular countywide interest by reason of its commercial uses, which benefit County and City residents. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Butte, pursuant to Decision Nos. 73078 and 82-01-18 of the California Public Utilities Commission, hereby authorizes the utilization of the necessary Rule 20A allocation credits, estimated to be approximately $1,395,000, from the cumulative amount currently allocated by Pacific Gas and Electricity Company to the County of Butte for the year 2016 for expenditure on the underground utility conversion prject to be carried out in said Underground Utility District No. 18 - Warner Street (West 2nd Street to West Sacramento Avenue) within the City of Chico.
