A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS ADOPTING THE MITIGATED NEGATIVE
DECLARATION FOR THE BUTTE COUNTY EVIDENCE BUILDING AND MORGUE PROJECT
WHEREAS, the original Butte County Evidence Building, built in the 1960's at roughly 2,500 sq. ft., does
not facilitate contemporary evidence handling procedures and will be demolished under ministerial building
permit because Section 21080 of the Public Resources Code exempts from the application of CEQA those
projects over which agencies exercise only ministerial authority; and
WHEREAS, the Evidence Building no longer meets the operational needs of Butte County in that the
corrugated metal structure lacks proper accommodations, including climate control, and is no longer
serviceable; and
WHEREAS, Replacement of the Evidence Building with an adequate Evidence Storage Building and
Morgue has been included in the Capital Improvement Program since 2004; and
WHEREAS, Butte County currently does not have a "Central Morgue," but rather contracts with local
mortuaries where autopsies are performed by a contracted forensic pathologist; and
WHEREAS, As recently as fiscal year 2012-13,the Butte County Grand Jury has recommended replacing
the existing Evidence Building with a new Evidence Storage Building and Morgue; and
WHEREAS, Butte County contracted with Nacht & Lewis to perform Architectural and Engineering
Performance Criteria design services for the new Evidence Storage Building and Morgue project in February,
2016; and
WHEREAS, Butte County is the lead agency for the Butte County Evidence Storage Building and Morgue
project per the California Environmental Quality Act (CEQA); and
WHEREAS, an Initial Study and Mitigated Negative Declaration was prepared for the Butte County
Evidence Building and Morgue Project and circulated for a 30-day public comment ending on September 23,
2016
WHEREAS,the Board of Supervisors has considered the Initial Study and Mitigated Negative Declaration
for the Butte County Evidence Storage Building and Morgue project at a duly noticed public hearing on
September 27, 2016; and
WHEREAS, the Board of Supervisors has considered all public comments received.
NOW,THEREFORE, BE IT RESOLVED, that the Board of Supervisors take the following actions:
I. Adopts a Mitigated Negative Declaration with the followng findings:
A. The proposed Evidence Storage Building and Morgue replaces an outdated and unserviceable
Evidence Building from the 1960's;
B. An Initial Study was completed in compliance with CEQA. Construction and operation of the
proposed Evidence Storage Building and Morgue will have no impact upon agricultural or
mineral resources;
C. Construction and operation of the proposed Evidence Storage Building and Morgue will have
a less than significant impact upon biological resources, geology and soils (geologic hazards),
land use, population and housing, public services, recreation, transportation/traffic, and
utilities and services;
O. Construction and operation of the proposed Evidence Storage Building and Morgue will have
a less than significant impact with mitigation incorporated for aesthetics/visual resources
(night-time glare), air quality(fugitive dust and diesel emissions), hydrology and water quality
(storm-water runoff and adequate drainage) and noise (construction noise).
E. The Board of Supervisors has considered the Mitigated Negative Declaration, together with
comments received during the review process.
F. On the basis of the whole record before the Board of Supervisors, including the Initial Study
and any comments received,there is no substantial evidence that construction and operation
of an Evidence Building and Morgue would have a significant impact on the environment.
The custodian of the record is the Department of Development Services. The location of the
record is 7 County Center Drive, Oroville CA 95965.
G. The Mitigated Negative Declaration reflects the independent judgment and analysis of Butte
County, which is the Lead Agency.
II. Finds that the collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5
is required prior to filing a Notice of Determination for the project, unless verification from the
California Department of Fish and Game is provided that the project is exempt from the fee
requirement. If a required fee is not paid for the prject,the prject will not be operative,vested
or final and any local permits issued for the prject will be invalid (Section 711.4 (c) (3)).
PASSED AND ADOPTED by the Butte County Board of Supervisors this 27th day of September, 2016, by
the following vote:
