A'11411,41eAc '; /i/M40,n;i0Pbtki"; ,Y41,40W,10' (wi' 7%;;),t,,f00;,Vir 01/74;;;;f,101477174,14r, IA dirk/04? l,;fWg;1% 4%04M'qrixtyPilylrefliiieweilf 4041,Alitinletltei lir P%15%0/*4girrq KO**7fiA //fA'kte'14 $/i 4,11*I; 4101 '01,(1')L;0614'1 61), rj%N 01/r,FA0A/VviY,/ 44,4 j4,444Y 44.4 /94'X:k 4 lif#4 640 / 4/4'"'°%/"`'' 'z'friPW1h4'49)(4Alf(M4 ix° frz 444000 14,114 4,200 (i'‘'.46,$'4;g1PW #44/K%'4447/4'*%1%41(4%0N4f;0%90r,g4leil*MieP l4Vr*%; )40;r2W;;42;',A3fp*,4 VP,P4'1",000 A4410 Resolution No. 16477 RESOLUTION AUTHORIZING USE OF RULE 20A CREDITS ALLOCATED BY PACIFIC GAS AND ELECTRIC COMPANY TO THE COUNTY OF BUTTE IN THE TOWN OF PARADISE PURSUANT TO DECISION NOS. 73078 AND 82-01-18 OF THE CALIFORNIA PUBLIC UTILITIES COMMISSION FOR SKYWAY UNDERGOUND DISTRICT NO. 16-1 WHEREAS, per Ordinance No. 156 of the Municipal Code of the Town of Paradise, a public hearing was called November 7, at the hour of 6:00 p.m., in the Town of Paradise Council Chambers, 5555 Skyway, Paradise, California, to ascertain whether the public necessity, health, safety, or welfare required the removal of poles, overhead wires and associated overhead structures, and the undergrounding of wires and facilities for supplying electric, communication, or other similar or associated service, within that certain area of the Town of Paradise on Skyway from Neal Road to 5700 Skyway; and WHEREAS, notice of such hearing was given to all affected property owners and utilities concerned in the manner and for the time required by law; and WHEREAS, such hearing was duly held, and all interested persons were given an opportunity to be heard; and WHEREAS, the Town Council of the Town of Paradise, pursuant to Resolution 16-75 of the Town of Paradise, has declared and determined that certain area within the Town of Paradise described as Underground District No. 16-1 - Skyway (Neal Road to 5700 Skyway), as more specifically described and delineated in Exhibit "A" attached and entitled "TOWN OF PARADISE, UNDERGROUND DISTRICT NO. 16-1, SKYWAY, to be an underground district for conduits, wires, and associated appurtenances for the purpose of supplying electric, telephone, cable television, and other similar or associated service by means of electrical materials or devices; and WHEREAS, the Underground Utility District created by said Resolution 16-75 of the Town of Paradise is in the general public interest for the following reasons: 1. The undergrounding to be accomplished will avoid or eliminate an unusually heavy concentration of overhead distribution facilities; 2. The streets, roads, or rights-of-way in the district are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic; and WHEREAS, the area contained within Underground Utility District No. 16-1 - Skyway (Neal Road to 5700 Skyway) is of particular countywide interest by reason of its commercial uses, which benefit County and City residents. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Butte, pursuant to Decision Nos. 73078 and 82-01-18 of the California Public Utilities Commission, hereby authorizes the utilization of the necessary Rule 20A allocation credits, estimated to be approximately $556,000, from the cumulative amount currently allocated by Pacific Gas and Electricity Company to the County of Butte for the year 2016 for expenditure on the underground utility conversion project to be carried out in said Underground Utility District No. 16-1 - Skyway (Neal Road to 5700 Skyway) within the Town of Paradise.
