HomeMy WebLinkAbout1640ORDINANCE NO. 1640 AN INTERIM ORDINANCE ZONING A PORTION OF TI3E COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "A--5" 1 (AGRICULTURAL) DISTRICT 2 The Berard of Supervisors of the County of Butte, State 3 of Ca1~.farnia under and pursuant to Ordinance Np: 475, as amended.., 4 and declaring an emergency, DO ORDAIN, as follows: 5 SECTION 1. The hereinafter described area situated in 6 the County of Butte, State of California, shall be and it is q hereby zoned as an "A-5" (Agricultural) District for a per~.od of $ 120 days, and such areav shall be subject to tha restrictions- and g restricted uses and regulations hereinafter specified and pro-- ZO vided. 11 Sa~.d area so zoned being located around the Oroville 12 Airport, mare particularly described as follows: lg Bounded by State Highway 162 (Oro Dann Boulevard Nest) on the south, 18th Avenue on the east, Grand Avenue 14 an the north and, being the west':.line of Sec 15 . on the west; located in Sec 14 and 15, T19N, R3E, MDB&M. Y5 SECTION 2. REGULATIONS FOR AN "A-5" DISTRICT: 16 The following regulations shall apply in an "A--5" 17 District: 18 2.1 USES PE KNITTED: is a. Single-family dwellings. 20 b. General farming, horticulture, commercial live- 21 stock, poultry production, warehousing, and storage. 22 c. Accessory buildings and uses pertinent to the 23 permitted uses, including agricultural processing 24 plants . 2S d. Housing facilities (,includ~.ng mabi le homes) to 28 --1-. l ~P ~~ 1 accommodate only agricultural employees and their 2 families employed by the owner or operator of the 3 premises; and provided further that such housi ng 4 facility shall be considered accessory to the main S building and shall conform to the provision per- 6 taming to the required yard and open space for 7 dwel li n.gs . S e. Mobile homes to house one family when such mobile 9 home is the only housing facility located on the 10 premises, provided the following condztior_s are 31 conformed to: 12 1. The floor area within the mobile home shall 13 not be less than five hundred (500} sq. feet. 14 2 . The parcel of land conforms to Section 2 .3 15 tMinimum lot area of 5 acres), or is a smaller 1B parcel of land lawfully created prior to the , 17 enactment of this ~rdinan.ce , subject to written 18 approval by the Director of Planning. 19 2.2 THE FOLL4WTNG USES SUBJECT TQ SECURING A USE 'PERMIT 20 IN EACH CASE: 21 a. Golf courses and Country Clubs. 22 b. Public or quasi--public uses including churches, 23 fire houses, hospitals and clinics, parks and 24 playgrounds, schools, public utility buildings 2S and professional buildings. 28 C. 'j' 2;.4 FRONT YARD REQL]'IRED: $ Minimum front yard shall be fifty (50) feet from 9 the centerline of the road, except where the road 10 is classified by the County as a Federal Aid 11 Secondary Road and the minimum building setback 12 shall be fifty--five (55) feet from the centerline 13 of the road. 14 2.5 SIDE YARD REQUIRED: 1S The minimum. si de yard shall not be less than five 16 (5) feet. 17 SECTION 3. All uses of land within the distract not 18 specifically authorized and permitted are prohibited. 19 SECTION 4 . In compliance with the provisions of said 20 Zoning Enabling Ordinance, the same is hereby amended by adding 21 this Ordinance in full. 22 SECTION 5. The penalties for the violation of the 23 zoning hereby imposed wi thin the distract Shall be as provided 24 in the boning Enabling Ordinance, this Ordinance shall from and ~ after its effective date become a supplement to and Dart of the 28 Zoning Enabling Ordinance. _~_ 1 SECTION 6.
