AN INTERIM ORDINANCE ZONING A-PORTION OF THE COUNTY OF BUTTE , STATE OF C.~L IFORN IA, A "TM-2 " { TIMBER- MOUNTAIN) DISTRICT 6 7' 9 10 ~.l 12 13 I4 15 16 17 18 is 20 21 22 23 24 25 28 The Board of Supervisors of the County of Butte, State of California, un der and pursuant to Ordinance No. 475, as amended, and declaring an emergency, DO ORDAIN, as follows: i SECTION 1. The hereinafter described area situated in the County of Butte, State of California, shall be and it is here-- by zoned as a "TM-2" (Timber Mountain) District-far a period of 60 days, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area sa zoned be~.ng located at Forest Ranch, and more part~.cularly described as follows All of Sec 5 and Sec 6, T23N, R3E, MDB&M, and. all. of Sec 31 and Sec 32, T24N, R3E, MDB&M. Excepting therefrom; the NEa of the SEa and the SE4 of the NEB Of Sec 6, T23N, R3E, MDB&M. Also excepting therefrom; the NW's of Sec S, T23N, R3E, MDB&M. Also excepting therefrom all that property on both sides of and within 350 ft . of the centerline of Hwy . 32. Alsv excepting therefrom Lot 2 of "Forest Ranch Unit No. 1" per map recorded in Book 34 on Pages 43 and 44 of the Butte County Recorder, SECTION 2. The following regulations shall apply in a "TM-2" (Timber-Mountain) District: 2.1 USES PERMITTED: a. Single-family dwellings, including mobile homes. b. Keep~.ng ar~d raising small animals for domestic use, .. ~. iz~cludinq dogs, cats and household pets, poultry and other bards , bees , fish and frogs . d. Keeping, raising and pasturing of cattle, horses, sheep, goats,~hogs or other livestock, provided that na more than two {2} such animals be kerat per acre on parcels of less than five (5} acres and no more .than four (4} such animals be kept per acre on parcels of five {5) acre or more . e . Prospecting, c1a~.ming, drilling, mining, excavating and dredging of mineral,•hydrocarban and geothermal resources, Axcept as limited in 2.2. f. Protection of land and forests from fire, erasion. flaods, slides, quakes, insects, .diseases and pollu- tian, including. arboretums and natural w~.lderness, experimental and study areas . g. Display and sales of products of agricultural uses and home arts and crafts produced on the premises. h. Accessory uses, improvements and structures custo- mary and pertinent to permitted uses , except as limited in 2.2, including guest houses, barns, sheds shops, garages and storage areas . 2.2 USES PER~lITT~D SUBJECT TO FIRST SECURING A USE PERMIT IN EACH CASE: a. Commercial wood processing plants. c. Commercial kennels and animal hospitals. d. Commercial livestock feed yards. e. Animal product processing plants. f. Mining, quarrying and excavating activities which might be objectionable by, reason of noise, odor, smoke, dust, bright light, vibration, stream pollu- tion or handling of explosives or dangerous material g. Commercial boat ramps, docks and landing facilities. h. Aircraft landing Facilities. i. Disposal areas and sewage treatment facilities. j. k~ublic and Quasi-public uses including schools, park playgrounds, recreational £acilities, utility system structures, meeting halls, hospitals, libraries, museums, government offices and similar uses. k. ~rzvate or commercial outdoor recreation facilities on sites of not less than f~.ve E5) acres, including country clubs, golf courses, riding academies and stables, hunting and fishing camps and other clubs, and gun clubs ,and ranges . 2 .3 LOT A~tEA Minimum required area of a lot per dwelling unit _~_ 1 2 3 4 5 8 7 8 s 10 11 Y2 13 i4 15 18 II i~ 18 19 20 2Z 22 23 24 26 26 shall not be less than two (2) acres, for "TM-2" . 2.4 LOT WIDTH .REQUIRED: Minimum required lot width shall not be less than sixty--five (6S) feet. 2 .5 FRONT YARD REQUIRED : ', Minimum required~° fro~it building setback shall be not less than, fifty (5d) feet from the centerline of the road, except where the road is~cZassified by the County as a Federal Aid Secondary Road, the minimum required front building setback shall be not less than fifty--five (55} feet fxom the centerline of the road. 2.6 SIDE YARD REQUIRED: Minimum required side building setback shall be r_ot less than five {5) feet for "TM-2" . 2.7 REAR YARD REQUIRED: Minimum required rear building setback shall be not less than five (5) feet for "TM-2". SECTION 3. All uses of land not specifically authorized and permitted in Section 2 are prohibited. _ SECTION 4, In compliance with the provisions of said Zon7ng Enabl~.ng Ordinance, the same is hereby amended by adding this ordinance in full. . SECTION 5 . The penalties for the vi olation of the zon- ing hereby imposed within tine district shall be as provided in the boning Enabling Ordinance . In compliance with the prov~.sions of _4 ]. 2 3. 4 6 6 7 8 9 10 I1 12 13 14 15 16 17 18 19 20 21 22 23 24 26 26 the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance , SECTION ~. This urgency ordinance shall take effect immediately upon its passage, and before the exp?rat~.on of fifteen (15) days after its passage shall be published oncR with the names of the members of the Board of Supervisors voting for and against the same in the Chico Enterprise-Record ~, a newspaper in genera]. c~.rcuiation in the County of Butte, State of Cal.fornia, The facts constituting the urgency qri which this Ordinance is based are I, That the area is presently under study for rezoning. 2. To be more consistent with the present land use.
