AN ORDINANCE ZONING A PORTION OF THE COUNTY OF
BUTTE, STATE OF CALIFORNIA, AN "S-2" (SUBURBAN)
DISTRICT, PURSUANT TO ORDINANCE NO. 475
The Board of Supervisors of the County of Butte, State
of Cal iforni.a, under and pursuant to Ordinance No. 475, of said
County being the Enalaling Ordinance, DO ORDAIN as follows:
SECTION ].. The hereinafter described area, si.tf~ated in
the County of Butte, State of California, shall be and it is
hereby zoned as an "S-2" (Suburban? District, and such area shall
be subject to the restrictions and restricted uses and regulations
hereinafter specified and provided. Said area so zoned being
located in the unincorporated area of Butte County, ne ~= Durham;
more particularly described as:
PARCEL ONE:
Farm Laborer's Allotment No. "U'", as the same is
designated and delineated on that certain Map en-
titled, "SUBDIVISIONAL PLAN OF THE DURHAM STATE
LAND SETTLEMENT, BEING A PORTION OF THE ESQUON
RANCHO, SITUATED NEAR DURHAM, BUTTE COUNTY,
CALIFORNIA", which map was filed in the Office
of the County of Butte, State of California, ::::.~
September l7, 1918, in Volume 8 of Maps, at
pages 16, l7, and 18.
PARCEL TWO:
Th at portion of Farm Allotment No, 45, as the same
is designated and delineated on that certain map
entitled, "SUBDIVISIONAL PLAN OF THE DURHAM STATE
LAND SETTLEMENT, BEING A PORTION OF THE ESQUON
RANCHO. SITUATED NEAR DURHAM, BUTTE COUNTY,
CALIFORNIA," which map was filed in the Office
of the County Recorder of the County of Butte,
State of California. September 17, 1918, in
Volume 8 of Maps, at pages 1~, 17, and 18, more
particularly described as follows: to-wit:
Beginning at the most northerly point of said
Farm Allotment Na. 45 which is also the Eastern
most extremity of Farm Laborer's Allotment No.

U, of the Durham State Land Battlement; thence along
the westerly boundary of said Farm Allotment No. 45,
S 19° QQ' W, 38.8 ft; thence continuing along said
westerly boundary S l9° 00' W, 342.2 ft; thence N
55° 09' E, 265.2 ft; thence continuing along last
named course N 55° 09' E, 34.5 ft, more or less to
the eastern or stream-side tae of the levee which
follows the western, bank of Butte Creek; thence in
a straight line to the point of beginning.
Containing 2 .5 acres , more or less .
SECTION 2. REGUItiATIONS FOR AN "S-2" DISTRICT:
The following regulations shall apply in an "S-2"
2.1 USES PERMITTED:
a. Single-family dwellings, not includ~.ng tents or
mobile homes.
b. Accessory buildings, pertinent to the permitted
area .
2.2 AGRICULTURAL, USES, EXCEPT LIVESTOCK SUBJECT T4 THE
FOLLOWING REQUIREMENTS:
a. For each horse or head of cattle over one year
(1} o£ age, eight thousand one hundred twenty-five
(8,125) sq. ft.
b. For each head of swine over ten (10) weeks of age,
eight thousand one hundred twenty--five {8,125) sg.
feet.
c. For each head of sheep or goats, two thousand

shall be not less than one (1) acre .
2 .4 LOT WIDTH :
Minimum lot width shall be not less than one hundred
thirty {130} feet.
2 . S FRONT YARD :
Minimum front yard shall be fifty {50} feet from
the centerline of the road except where the road
is classified by the County as a Federal Aid
Secondary Road, the minimum building setback
requirement shall be fifty-five (55) feet from
the centerline of the road.
2 .6 S IDE YARD
Minimum side yard shall be not less than ten {lp) ft~
SECTION 3. The following uses subject to securing a
use permit in each case:
a. Public and quasi-public uses, including churches.
b. Hospitals, parks and playgrounds, schools, and
public utility buildings.
SECTION 4. All uses of land within the district not
specifically authorized and permitted are prohibited.
SECTION 5. In compliance Frith the provisions of the
Zoning Enabling Ordinance.
SECTION 6. The penalties for the violation of the
zoning hereby imposed within the district shall be as provided
in the Zoning Enabling Ord~.nance. In compliance with the pro-
visions of the Zoning Enabling Ordinance, this Ordinance shall

be from and after tis effective date become a supplement to and
part of the Zoning Enabling Ordinance .
SECTION ~7. This Ordinance shall be and it is hereby
dec]:ared to be in full force and effect from and after thirty
f30) days after the date of its passage, and before the expira-
tion of fifteen (15} days after its passage, this Ordinance shall
be published once wz.th the naives of the members of the Board of
Supervisors voting for and against it in the
Chico Enterprise-Record , a newspaper published ~.n +,_he County, of
Butte, State of California.

County of Butte, State of California, this 25th day of
November 19 75 , by the following vote
