AN ORDINANCE AP•'iENDING SECTION 20-4$ OF CHAPTER
20 OF THE BUTTE COUNTY CODE
The Board of Supervisors of the County of Butte, State
of- California,---do~ ordain .as: follows :... _... .. _ _ _.... ......_. ._.._.........._
Section 1. Section 20--48 of the Butte County Code
enac~..~d by Ordinance No. loll is amended to read as follows
Section 20w48, Conditional Issuance of Certificate
of Compliance . If the Subdivision Committee determines that
such real property does not comply with the provisions of the
Subdivision Map Act or of this chapter, but that development of
such real property would not be contrary to the public health
or•:.':the public safety, it may grant a Certificate of Compliance .
In such cased the Committee may, as a condition of granting a
Certificate of Compliance, and in order to protect the public
health or the public safety, impose such conditions as would have
been applieabls to the division o~ the property at the tune fine
current owner of record acquired the property. Such conditions
may be fulfilled and implemented by the property owner who applie
for the cert~.f~.cate or by a grantee of such property owner. If
such conditions are nat fulfilled or implemented, the Certificate
of Compliance shall have no force or effect upon any subsequent
transfer of the property, and any subsequent transferee or assign
shall make anew applwcation fora Certificate of Compliance
pursuant to Section 20-46, and the Subdivis~.on Committee may
impose such conditions as would have been applicable at the time
such assignee or transferee acct.uired the property.

of the Subdivision Committee, the current owner of record may
request that a Notice of Compliance be failed with the Butte
~~ County Recflrder . Said Notice a~ ~Comp1.~ ante sha~a-~dent? fy~ the
real property, the book and page of the previously recorded
Certificate of Compliance and shall estate that the conditions
of the Certificate of Compl~.ance have been fulfilled to the
sat~.sfaction of the Subdivision Committee.
That this Ordinance shall take effect 30 days after
the date of its adoption, and prior to' the expiration of fifteen
(15) days from the passage thereof shall be published at least
once in the Oxovil~e Mercuxy , a newspaper of
general circulation, pub fished and circulated in the County of
Butte ~,aith the names of the members voting for and against the
same .
