HomeMy WebLinkAbout1662ORDINANCE NO. 1662 1 2 3 4 6 6 7 8 9 10 11 3.2 13 l~ 15 ],8 17 18 19 20 21 22 23 24 23 28 AN ORDINANCE ~ONTNG A PORTION OF THE COUNTY DF BUTTE, STATE OF :CALIFORNIA, A "R-1 A&C" (SINGLE FAMILY RESIDENTIAL ARTS & CRAFTS) DISTRICT, PURSUANT TO ORDINANCE NO. 475. The•~oard of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475, of said County being the Enabling Ordinance, D4 ORDAIN as follows: SECTION 1. The hereinafter described area,, situated in the County of Butte, State of California, shall be and it is hereby zoned as an "R-1 A&C" (S~.ng3.e--Family Residential Arts & Crafts) District, and such area shall be subject to the restric- tions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincor- porated area of Butte County, Paradise, more particularly des- cribed as follows: A portion of the SWa of Sec 11, T22N, R3E, MDB&M, described as: Parcel 1: All that property in said Sec 11 baunded on the west by Lucky John Rd. , on the south by Bille Rd. and on the north and east by Posey Lane. Parse 1 2 : Lots 1, 2 , 3, and 4 of parse 1 map recorded in Map Book 50 on page 51 of the Butte County Recorder and also that property bounded on the north, east and . south by said lots of sa~.d parcel map, and on the west by Lucky John Rd . Parcel 3: That property bounded on the west by Posey Lane, on the south b.y Bille Rd., on the east by Skyway and on the north by the north line and its easterly prolongation of Lot 2 of parse]. map recorded in Map Book S2 on page 49 of the Butts County Recorder. Excepting therefrom all that property located within 350 ft . of the centerline of Skyway . Containing 2.8 acres, mare or less. SECTION 2. REGULATIONS FOR AN "R-1 A&C" DISTRICT: The following regulations shall apply in an "R-1 A&C" District: 2.1 USES PERMITTED: a. Single-family dwellings, not including tents or trailers . b . Accessory buildings pertinent to the permitted uses. c. The following uses are considered to be accessory uses and are permitted in the R-~l A&C zone only when conducted on the premises with a residence occupied and used as a residence by the proprietor of such use, and no display or display window visi- ble from a street shall be permitted: 1. Domestic arts and crafts, including but not limited to the following: a) ceramics b) needlework c) dressmaking d} art studio, including photography e} lapadarist, and 2. SECTION 3. A11 uses of land eat specifically authorized and permitted under Section 2 are prohibited within the district, SECTION 4. In compliance with the provisions of the Zoning Enabling Ordinance, the same is hereby amended by adding this Ordinance i n full . SECTION 5. The penalties for the violation of the zaning hereby i~t~os~d within the district shall be as provided in the Zoning Enabling Ordinance . In compliance with the pro- visions of the Zoning Enabling Ordinance, this ordinance shall be from and after its effective date became a supplement to an d part of the Zoning Enabling Ordinance. SECTION 6. This ardin ance shall be and it is hereby I declared to be in full force and effect from and after thirty (30) ~ days after the date of its passage, and before the exp~.rati on of fifteen (15) days after its passage, this Ordinance shall be pvb - lished once with the names of the members of the Board of Super- visors voting £or and against it in the Paradise Post a newspaper published in the County of Butte, State of California.
