AN INTERIM ORDINANCE ZONING A PORTION OF THE
COUNTY OF BUTTE, STATE OF CALIFORNIA, A "TM-5"
(TIMBER MOUNTAIN) DISTRICT
1 The Board of Supervisors, of the County of Butte, State

amended, and declaring an emergency, DD ORDAIN as follows.
~ SECTION to The hereinafter described area situated in
5 the County of Butte, State of California, shall be and it is
6 hereby zoned as a 'ATM-5" (Timber Mountain) District fora period
7 of 120 days, and such area shall be subject to the restrictions
$ and restricted uses and regulations hereinafter specified and

10 Said area so zoned being located in Butte Creek Canyon,

SECTION 2. REGULATIONS FORA "TM-5'" DISTRICT:
The following regulations shall apply in a 'tTM-5'E
District:
2.1 USES PERMITTED:
a. Single-family dwellings, including mobile homeso
b. Management, raising, harvesting and removal of
trees, shrubs, seedlings, flowers, herbs and all
food crops for human or animal consumptionP

Keeping and raising small animals for domestic
2 use, including dogs, cats and household pets,

4 d. Keeping, raising and pasturing of cattle, horses,
5 sheep, goats, hogs, or other livestock, provided

9 per acre on parcels of five {5} acres or morem
10 e. Prospecting, claiming, drilling, mining, excava-
11 Ling and dredging of mineral, hydrocarbon and

academies and stables, hunting and fishing camps

2.4 LOT WIDTH REQUIRED:
Minimum required lot width shall not be less than
sixty-f ive {65 ) feet.
2.5 FRONT YARD REQUIRED:
Minimum required front building setback shall be
not less than fifty (50) feet from the centerline
of the road, except where the road is classified
by the County as a Federal Aid Secondary Road, the
minimum required front building setback sha11 be
not less than fifty-five (55) feet from the center-
line of the road.
2.6 SIDE YARD REQUIRED:
Minimum required side building setback shall be
not less than ten (10) feet for `~Ti~I-5".
2p7 REAR YARD REQUIRED:
Minimum required rear building setback shall be
nat less than ten {10) feet for "TM-5".
SECTION 3. All uses of land not specifically author-
ized and permitted under Section 2 are prohibited within the
district.
SECTION 4. In compliance with the provisions of said
',Zoning Enabling Ordinance, the same is hereby amended by adding
this Ordinance in fullo

1 SECTION 5. The penalties far the violat~.on of the
2 zoning hereby_mposed within the district shall be as provided in

3 the Zoning Enabling Ordinance. Tn compliance with the provisions
4 of the Zoning Enabling Ordinance, this Ordinance shall from and
5 after its effective date become a supplement to and part of the
B Zoning Enabling Ordinance.
7 SECTION 6. This urgency ordinance shall take effect
8 immediately upon its passage, and before the expiration of
9 fifteen (15) days after its passage shall be published once with
10 the names of the members of the Board of Supervisors voting for
~-1 and against the same in the Chico Enferprise~~2ecord ~~~^~, a
12 newspaper in general circulation in the County of Butte, State of
13 California. The facts constituting the urgency on which this
].4 ordinance is based are:
