"" ,! r !r r/ :. r rl ,/d. r /„/ / / ✓ r(rri/r r ,�: / i, r r rr/rr rj r �� /1✓irr/!r%/ria rr .'rG” ':fir / f%' / j/i; /' r / / 'i/ / /� ///i /lr1 / //r rj/i s in////�/ ( r; I,I,,,� / %ir r r r� ra / �'d";`,, i ,a,. r f ;.. r/ r //l r 1 ✓rr ri/^rrl y rl,,,,r 1 r %r/ 'r/;' ,",: ';s� �,,: ,r r/, r / Ia Gl.. / r,,, ,;,. ,,, ,.. , ,,,. re: ,e; r r r 1!/ /i/ r r ! / // r ✓i J(o.,.. ,r,:,,/ r ,.�r i., tri /,. r a / r e / r :/r,✓ . /�,/r!r// �r/i// �a ^� �/ rir � / r rr // r /. r r r r r ./ r � ,rr f rl :r /r/✓ // r �/% Resolution No. 17-019 RESOLUTION RATIFYING THE PROCLAMATION OF A LOCAL EMERGENCY FOR THE OROVILLE SPILLWAY INCIDENT AND REQUESTING THE GO,VERNIOR PROCLAIM THE COUNTY OF BUTTE TO BE IN A STATE OF EMERGENCY AND REQUESTING THAT THE GOVERNOR OF THE STATE OF CALIFORNIA PURSUE A PRESIDENTIAL EMERGENCY DECLARATION OF DISASTER WHEREAS,Section 8-5 of the Butte County Code empowers the Chief Administrative Officer of the County of Butte to proclaim the existence, or threatened existence of a local emergency when the county is affected, or likely to be affected, by a local emergency and the Board of Supervisors is not in session; and WHEREAS, conditions of extreme peril) to the safety of persons and property have arisen within the County of Butte, commencing February 7, 2017, due to damage to both the auxiliary and primary spillways of the Oroville Dam, coupled with historically high water levels in the lake; and WHEREAS, the damage to the spillways could have resulted in the failure of the spillways potentially resulting in catastrophic flash flooding (Oroville Spillway Incident), which led to the mass evacuation of residents in the communities of Oroville, Palermo,Thermalito, and Kelly Ridge, and all low lying areas around the Feather River, which included Gridley and Biggs; and WHEREAS, the conditions of extreme peril did warrant and necessitate the proclamation of the existence of a, local emergency; and WHEREAS, at the commencement of the local emergency the Board of Supervisors was not in session (and could not immediately be called into session); and WHEREAS, the Chief Administrative Officer of the County of Butte proclaimed the existence of a local emergency within the County of Butte on the 13th day of February, 2017; and WHEREAS, it is hereby found that local resources are unable to cope with the effects of said emergencies, the County of Butte requests California Disaster Assistance Act (CDAA) Funding be made available,. NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED that the Proclamation of Existence of a Local Emergency with respect to the Oroville Spillway Incident and the request to the Governor to declare a State of Emergency as issued by the Chief Administrative Officer are hereby ratified and confirmed by the Board of Supervisors of the County of Butte;. and. IT IS FURTHER RESOLVED AND ORDERED that the Proclamation of Existence of a Local Emergency with respect to the Oroville Spillway Incident described above shall be deemed to continue to exist until its termination; and IT IS FURTHER RESOLVED AND ORDERED thatcluring the existence of said local emergencies the powers,functions and duties of the emergency organization of this County shall be those prescribed by state law, by charter, ordinances, and resolutions ofthis County, and bythe County nfButte Emergency Plan; and IT IS FURTHER RESOLVED AND ORDERED that a copy of this resolution be forwarded to the Director of the Governor's Office ofEmergency Services; and IT IS FURTHER REQUESTED that the Governor of the State of California pursue a Presidential Declaration of Disaster for Butte County for the Omov0eSpillway incident; and: IT IS FURTHER RESOLVED AND ORDERED that Cindi Dunsm,00r, Emergency Services Officer of the County of Butte, [shereby designated asthe authorized representative nfthe County nfButte for the purpose ofreceipt, processing, and coordination of aUl inquiries and requirements necessary to obtain available State and Federal disaster assistance.
