RESOLUTION OF THE COUNTY OF BUTTE, BOARD OF SUPERVISORS
DELEGATING AUTHORITY TO THE COUNTYADMINISTRATIVE OFFICER TO DEVELOP AND IMPLEMENT
PROCESSES TO TRANSACT PERSONNEL RELATED IMPACTS FROM THE OROVILLE EMERGENCY/AUIXILI'ARY SPILLWAY
INCIDENT
WHEREAS,on February 12,2017 at 4:21 pm the Butte County Sheriff, Kory Honea, issued an immediate evacuation
order due to damage to the Oroville Dam emergency/auxiliary spillway, which could have resulted in the failure of the
spillway and catastrophic flash flooding (Oroville Spillway Incident). As a result of the immediate evacuation order,
residents in the communities of Oroville, Palermo,Thermalito,and Kelly Ridge, and all low lying areas around the Feather
River, including Gridley and Biggs were required to evacuate; and
WHEREAS, the issuance of the immediate evacuation order resulted in the establishment of an emergency
operation center, and the closure of highways and public facilities in and around the Oroville area, including all County
operations located in Biggs, Gridley and Orovilie; and
WHEREAS,Sheriff Honea's evacuation order remained in effect until February 14, 2017 at 1:00 pm and as a result,
County employees were prohibited from reporting to work in Biggs, Gridley and Oroville locations for two business days,
February 13th and February 141h 2017 (County Closure Days), and
WHEREAS, the hazardous situation that caused the closure of the County facilities has created complex
administrative and personnel issues that are currently being identified, assessed and; discussed, and will require
expeditious resolution over the coming days in order to maintain the efficient operation of county government; and
WHEREAS, the Oroville emergency spillway incident,which is out of the control of the County and its employees,
has created an unique and dynamic situation; and
WHEREAS,the County places the safety of constituents and employees as its main priority; and
WHEREAS, while the County(1) is not legally required to pay non-exempt employees for the County Closure Days
and (2) is permitted to require exempt employees to utilize vacation or administrative leave for the County Closure Days,
it is in the best interests of the County that employees who were prohibited from serving during the County Closure Days
and suspended County operations should not be financially burdened.
NOW,THEREFORE, BE IT RESOLVED:
1.The Butte County Board of Supervisors delegates authority to the Chief Administrative Officer, in:consultation with the
Director of Human Resources, to develop, implement and report back to the Board of Supervisors on the processes and
payroll rules developed to compensate employees who were unable to work on February 13 and; 1.4, 2017 due to the
immediate evacuation order.
2. The Board of Supervisors finds that there are several public purposes supporting this compensation, including the
resolution of uncertainty surrounding this issue, resolution of potential inconsistency in the treatment of employee
compensation,the continued recruitmentand retention of competentand skilled government employees and maintaining
the County of Butte's position in the competitive labor market, efficiency and the avoidance of potential labor disputes,
and that therefore, employee compensation for the County Closure Days is not a prohibited gift ofpublic funds.
3.This resolution is not precedent setting.
