HomeMy WebLinkAbout17-039 rr t✓ , , r r i e r� ✓ J , r 1, ✓, i / ,/ ✓ i, /% / / ✓,. ,l ✓ / it���11r ��1 lr G r � � e � ,, r, i��,�✓r;,tlr , ✓ , ✓ ,� / 1, � / ✓ ✓ ,, ,, �/ / ,., / , , 1, r„lei � � l / /, ✓ / / �1 , � /, 1..,, ,;✓ , lei°✓1 r / ,✓ ✓ i ✓ ✓ ✓/- f � r , ✓ r 1, „r , ,, i ,� 1 / r �, ✓ i ✓ ,✓ �✓ .� h / //' r, l /� i/r� i, ,/ Wil„ I , ,✓ ,,�/ ✓✓✓i ,L,,/(��,ei,,�/ ,� ,,.,� ,,,,,a...,,,,, ei,,..,,,..,, �� /,1 ./�rr��✓lre.�,,.,,,,.ai ,� ,. ✓����i��/l.,/�,r..,i�,r�f✓ ✓✓�.,, /�,,,,/.,.,,/�,✓%�,.,,�rilu,%�,1✓�✓�ir,✓,e,,./i✓il�/,.,,i, ,, ii,,,,.,,.c: Resolution No. 17-039 RESOLUTION WAIVING THE PUBLIC CONTRACT CODE BID REQUIREMENTS FOR EMERGENCY ROADWAY REPAIRS NECESSARY AS A RESULT OF THE DEPARTMENT OF WATER RESOURCES' SPILLWAY INCIDENT WHEREAS, on Sunday, February 12, 2017, Butte County was notified of the potential for imminent failure of the Oroville Dam's Emergency Spillway; and WHEREAS, Butte County's Emergency Operation Center was activated late in the afternoon on February 12, 2017; and WHEREAS,the State Department of Water Resources immediately hired contractors to begin hauling very heavy loads of rip rap, 24 hours per day, into the Spillway site, to stabilize the Spillway in order to stabilize the structure; and WHEREAS, this combination of very heavy truck loading, along with heavy rainfall, caused a significant degradation in the condition of Canyon Drive, and several other County maintained roadways; and WHEREAS, with the inclement weather, evacuation warning for the potential Spillway failure, and significant areas of failed roadways,there were not enough County resources to effectively maintain the roadways in a safe condition; and WHEREAS, Franklin Construction was retained on a time and materials basis, to assist with placement of steel plates to span the failed sections of roadways, and to provide on call emergency roadway maintenance services. NOW,THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte: 1. Butte County roadways were significantly impacted by the potential failure of the Emergency Spillway at the Oroville Darn, and the resulting heavy truck loading across County maintained roadways. 2. This heavy truck traffic significantly damaged some County Roadways. B. County resources were not able to keep up with the onslaught of damage from the heavy truck loading. 4. Repairs included leveling the failedareas with temporary asphalt concrete, and then placement of heavy steel plates to span the failed areas. 5. These repairs were of an emergency nature, caused by the immediate and continuous heavy truck loading. B. Due,to the continuous life safety threats of these roadway failures, it was not possible to delay repairs until a normal competitive bid could be accomplished. 7. Pursuant to California Public Contract Code Section 22050, the immediate approval of a written contract with a local construction firm, with the proper equipment and expertise to assist with the emergency maintenance of this roadway, was necessary to respond to the emergency, to maintain proper access for resources streaming into the Spillway area, and to protect the citizens that utilized these roadways on a daily basis.
