RESOLUTION ABANDONING PUBLIC RIGHTS OF WAY ALONG
PORTIONS OF ROCK CREEK DRIVE IN THE ROCK CREEK AREA
WHEREAS, This matter came on regularly for hearing before the Board of Supervisors of the County of
Butte, State of California, on March 28, 2017, in the Board Chambers, Butte County Administration Building,
5 County Center Drive, Oroville, California; and:,
WHEREAS, it appears to said Board the notice of the time and place of the hearing on the petition for
the abandonment of the puiblic right of way in question was duly and regularly given as required by Naw; and
WHEREAS,testimony and evidence, both oral and documentary, hawing been produced at said hearing,
from which said Board now finds that: (1) there is no passibility the proposedabandonment of this public
right of way may have a significant effect on the environment, and it is therefore not subject to the California
Environmental Act; (2) the proposed abandonment is in conformance with the Butte County General Plan;
and (3)the public right of way in question, as hereinafter described is unnecessary for present or prospective
public use.
NOW,THEREFORE, BE IT RESOLVED by the Board of Supervisors:
1. That the public right of way situated in the County of Butte, State of California, as hereinafter
more particularly described, are hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the
California Streets and Highways code (commencing with Section 8320),
2. That said public rights of way so abandoned are located in the unincorporated area of the
County of Butte, State of California, in the Rock Creek area. The street is more particularly identified as
follows,:
The westerly extension of Rock Creek Drive from the north end of the County maintained portion
of Rock Creek Drive and are more particularly described, in the Attached Exhibit A, and
shown on the Attached Exhibit B.
3. That a map showing the right of way hereby abandoned is on file in the Office of the Butte
County Department of PublicWorks, 7 County Center Drive, Oroville, California 95965.

All that real property situate in the County of Butte, State of California, lying in Sections
14 and 15, Township 23 North, Range I East, Mount Diablo Meridian, described as
follows:
Rock Creek Drive(formerly Rock Creek—Cana County Road) as shown and described
on that Official Map of Rock Creek—Cana County Road, filed for record in the office of
the Butte County Recorder in Book 3 of Maps, at page 9�7; and as offered for dedication
on that Parcel Map for Dorothy Hall, filed for record in the office of the Butte County
Recorder on August 25, 1978, in Book 67 of Maps at pages 92 and 93; and as offered for
dedication on that Parcel Map for Dorothy S. Hall filed for record in the office of the
Butte County Recorder on February 28, 1980, in Book 76 of Maps at pages 4 and 5.
EXCEPTING 'THEREFROM that portion of Rock Creek Drive as described in that deed
to the County of Butte recorded in Book 2490 at page 655, Official Records of Butte
County.
ALSO EXCEPTING THEREFROM that portion of Rock Creek Drive lying within
Parcel 1, as said Drive and Parcel are shown on said Parcel Map for Dorothy Hall, filed
for record in the office of the Butte County Recorder on August 25, 1978, in Book 67 of
Maps at pages 92 .and 93.
