Resolution No. 17-107
RESOLUTION DECLARING.TAIL ROAD AS COUNTY HIGHWAY
AND REQUEST FOR CONSENT FROM OROVILLE CITY COUNCIL
WHEREAS, the County of Butte has constructed and maintained the roadway commonly known as Jail
Road, located within the Butte County Government Center and more particularly referenced in the Butte County
Government Center map attached as Exhibit A, and
WHEREAS, this specific roadway designated in Exhibit A and referenced, hereafter, collectively as
°roadway,” though owned and maintained by the County of Butte, has not previously been formally declared and
adoptedas a County Highway; and
WHEREAS, this roadway lies wholly within the incorporated city limits of the City of Oroville and
WHEREAS, the Butte County Board of Supervisors desires to designate this roadway as a County Highway
for the purposes of acquisition of rights of way, construction, maintenance, improvement or repair, and, for the
purpose of adding the mileage of this roadway to the county's total mileage of maintained roads, thus rendering
this roadway eligible for Highway Users Tax Fund certification, calculation, and distribution in accordance with
Section 2104 of the Streets and Highways Code; and
WHEREAS, Streets and Highways Code Section 1700 grants the Board of Supervisors authority to declare,
by resolution upon approval by 4/5 vote of its members, that any highway in the county lying in whole or in part
within a city to be a County Highway.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California,
that:
1. Pursuant to the authority of Streets and Highways Code section 1700, the Board of Supervisors does
hereby declare, upon a positive 4/5 vote of its members, that the roadway described above is
hereafter designated as a county highway for the purposes of acquisition of rights of way,
construction, maintenance, improvement, repair, and for certification as part of Butte County's
total mileage of maintained roads for purposes of Highway User's Tax Fund certification,
callculation, and distribution in accordance with Section 2104 of the Streets and Highways Code.
2. Pursuant to Streets and Highways Code section 1701, the Board of Supervisors formally requests
that the Oroville City Council consent to this designation and declaration. County staff is directed to
transmit this resolution and this Request for Consent to the Oroville City Council to seek Council's
formal consent.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of California, this 27th day
of June, 2017, by the following vote:
AYES: Supervisors Wahl, Kirk, Lambert,Teeter, and Chair Connelly
